. l/ b# g, Z4 {/ c" B 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
2 Z) t6 e# L; r    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。0 q1 A; j. W8 F( L
    第三条    中华人民共和国不承认中国公民具有双重国籍。
7 B" D) v. \+ w2 o    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
% a$ i$ {( X: l6 C0 {& q    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。  z# k+ F, g; c( N, A
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。5 N3 K8 Q& o6 R' y: l$ ~
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
) F8 A- r% o7 T/ `( E& R8 M- ?    一、中国人的近亲属;
3 d$ f+ _" `; I, [$ F# M& @    二、定居在中国的;
; B$ Y5 b: |, R8 ^! v0 i    三、有其它正当理由。5 @2 P7 L* M' e
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
( x9 L8 k% Q5 b, e    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
6 o) {. T) O7 b4 L    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:% v, a, O! D, P# w8 L& j- l
    一、外国人的近亲属;* w- F4 [( n# w. V( ]" {
    二、定居在外国的;5 f: ]* Y* B2 H
    三、有其它正当理由。7 m$ \/ q* J! c2 D. l& Q- ?3 ?& J! u
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。8 q. i* C' ?/ S
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
7 s" `1 q' [% L, Z2 f3 s2 O3 B7 U. p    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。5 V* |, Z; G, y: s+ _( k: m( T. G2 z
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。1 y' O  o) N9 X8 Y- x3 H
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
/ T! p- U4 v2 k; M    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
& L  V. x* t* z0 ]3 N    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。
! x- W% [5 h+ Z6 c8 Z    第十八条   本法自公布之日起施行。

This Law is  applicable  to  the  acquisition,  loss  and  restoration  of; w3 O3 r2 @0 ~; ^' i6 `6 H; r( A# z
nationality of the People''s Republic of China.
$ K! Y4 o) G8 pArticle 2
/ |/ R; t" y  e" l5 b; R) u3 S& X( \9 xThe People''s Republic of China is a unitary multinational  state;  persons3 G# a! i" C8 `  w
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese; o' Z+ Y2 u# m0 I8 t
nationality.( n; U% m$ a. U0 O$ K$ M! D
Article 3
8 A- p, [% L2 O' n) o+ V5 hThe People''s Republic of China does not recognize dual nationality for any
- z8 o( j) q% M3 ?! Y' h' c" ZChinese national.
5 j7 v7 |7 V: O) Q3 k& uArticle 4
% |" R7 j7 G9 [* c# w- tAny person born in China whose parents are both Chinese nationals  or  one0 S; s3 j5 d5 ^: b
of whose parents is a Chinese national shall have Chinese nationality.

. ~, p" v) d9 r3 C1 i& G$ n( ?Any person born abroad whose parents are both Chinese nationals or one  of" t# e) u+ n3 y  E* e5 n$ ?2 T
whose parents is a Chinese national shall have Chinese nationality. But  a$ i$ T$ |% I4 a& L& H& k: w
person whose parents are both Chinese  nationals  and  have  both  settled1 n. l/ p7 v) L
abroad, or one of whose parents is a  Chinese  national  and  has  settled
" t, Q% _5 s; }7 ^' uabroad, and who has acquired foreign nationality at birth shall  not  have
' m0 ~+ D( ~' N9 [8 d) {# S1 O$ RChinese nationality.4 z9 L/ j7 [3 z/ N
Article 6
5 u& h* x, A5 g" b9 G3 l  sAny person born in China whose  parents  are  stateless  or  of  uncertain
* \) u2 L( G9 s# y7 i  D. w% Lnationality and have settled in China shall have Chinese nationality.! M+ ~5 w/ Y. g) J$ T
Article 7
5 N2 [. R. c6 ?' l& RForeign nationals or stateless persons who are willing to abide by China''s4 u! C) A* g$ [+ z; Z
Constitution and laws and who meet one of the following conditions may  be
0 Y) i" G  a; l* f" unaturalized upon approval of their applications:
. Y6 G4 R* F! C* a  w* K% k6 i* p(1) they are near relatives of Chinese nationals;  O# g4 }/ H1 |3 }' D' |+ v: z
(2) they have settled in China; or' _) a; d# g: F, u. M! [* ~2 O
(3) they have other legitimate reasons." k- T$ }5 _/ E5 W0 J
Article 8& _6 z2 ^2 e. e
Any person who applies for naturalization  as  a  Chinese  national  shall
* ?- {4 a* c4 g6 tacquire Chinese nationality upon approval of  his  application;  a  person+ H1 ^: l+ `: w
whose application for  naturalization  as  a  Chinese  national  has  been. ?  y/ J( y1 }1 M% I6 T
approved shall not retain foreign nationality.- D! @, S  a% x
Article 9
. g9 {6 J. n* b8 y  G( aAny Chinese national who has settled abroad and who has  been  naturalized
5 l! t, h' U' g1 {as a foreign national or has acquired foreign nationality of his own  free/ {5 v: N3 E% h0 }' Y1 K: @6 P  u2 p/ Y
will shall automatically lose Chinese nationality., o2 r9 B7 s" q5 [+ v# O% F' K1 c
Article 10
* c7 L7 O$ x7 E" oChinese nationals who meet one of the following  conditions  may  renounce
5 k' |3 S! l% k4 wChinese nationality upon approval of their applications:/ ^5 Y& L0 W: z8 u# s
(1) they are near relatives of foreign nationals;
$ q/ M, L% y6 H5 ~4 F! c0 ^2 B(2) they have settled abroad; or7 W+ B3 C; d) m
(3) they have other legitimate reasons.
2 h3 j7 L* R0 WArticle 11" U8 ~5 K1 Z' k3 V
Any person who applies for renunciation of Chinese nationality shall  lose% t/ f/ i1 w- h' a6 J
Chinese nationality upon approval of his application.. L6 o) n  I+ |8 `( V( ^- ~; F
Article 12
& I! O0 s% X) C7 _' _/ zState functionaries and military personnel on  active  service  shall  not7 R5 ~/ n8 e* w6 c8 X  Q# ~
renounce Chinese nationality.
) a0 Y* V* o" ~1 EArticle 13
1 w' h# E! h" z& y; `Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for' v, s( k- h+ m
restoration of Chinese nationality if they have legitimate reasons;  those
6 S! c+ K: z- d+ q) m- a6 Uwhose applications  for  restoration  of  Chinese  nationality  have  been
1 Y, B; A1 }5 x5 K0 W3 |' V  u. u/ W4 Xapproved shall not retain foreign nationality.
" j' I3 J+ U: ^! Z, HArticle 14
- Y& p1 D9 s* T* _Persons who wish to acquire, renounce or restore Chinese nationality, with1 A+ o0 G8 G9 v& f  R8 f
the exception of the cases provided for in Article 9, shall go through the* B: q( E% r. a' x. n1 q4 Y( ?
formalities of application.  Applications of persons under the age  of  18
; E6 L+ p4 c; D1 L) C9 F( G3 Xmay  be  filed  on  their  behalf  by  their  parents   or   other   legal
/ z; `  ?7 A  n9 q2 s2 o8 L/ A$ Erepresentatives.
  K2 d, n3 x0 `Article 15% z/ H$ @& y' q- B9 f
Nationality applications at home shall be handled by the  public  security
( z; v) r1 m- p3 w" R" xbureaus of the municipalities or counties where the applicants reside;; M/ V/ h  Q+ E3 j9 N- X
nationality applications abroad shall be  handled  by  China''s  diplomatic
, ^) @) ~2 |( I* h7 srepresentative agencies and consular offices.2 X- B' X" r0 Z
Article 163 S# }8 x& W4 G0 A
Applications for naturalization as Chinese nationals and for  renunciation" z$ Y# x* }& I% b
or restoration of Chinese  nationality  are  subject  to  examination  and
# \9 \% C% M' T( }6 F1 \) J4 D+ N$ [0 Dapproval by the Ministry of Public Security of the  People''s  Republic  of, T& |& x- j3 o" @7 l" E  }# }
China. The Ministry of Public Security shall issue a  certificate  to  any
& [1 O. h1 Q8 r6 u4 S" U4 rperson whose application has been approved.$ V9 U! s* w) `8 e1 c
Article 179 {/ l( j  s& M1 p: B8 b
The nationality status of  persons  who  have  acquired  or  lost  Chinese  K5 h6 A) |7 U9 [# F3 F
nationality before the promulgation of this Law shall remain valid.* z4 M7 I: T, F/ x: g! \# t
Article 18
7 k2 B( h4 a% u# K% {This Law shall come into force on the day of its promulgation.
