第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。! t& V7 m, R! D- k- u& r) d
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。2 n: I8 O- K) W1 V* L
第三条 中华人民共和国不承认中国公民具有双重国籍。( `7 T2 ~9 d# q9 n" [1 W* G4 E8 j
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
3 ], W: O- J+ x8 H9 R 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。7 \$ z! J, w( q2 q9 _: v! g
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。2 g$ s- K/ a, J$ s1 c7 |
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:) z0 Q3 O. p N4 i+ @. {
一、中国人的近亲属;- \* G: \, C: D. U4 _8 H$ k. z
二、定居在中国的;) f9 I8 V: u8 K' r4 K/ _ ^
三、有其它正当理由。
l4 R% \0 D+ G$ u! _9 f0 C8 g 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
9 r# [7 f& m4 M" y" c* x; P 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。, a) u8 A5 ?, D- h$ j" f
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:8 V# y3 j" O- ~: s
一、外国人的近亲属;% e( C. X, Q2 K' |* m Y
二、定居在外国的;
& f, _/ X" W3 i4 l) ` 三、有其它正当理由。7 b+ H' _+ q' | N$ I
第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
# i0 ? |! X/ ?9 J* H/ u+ C5 Y 第十二条 国家工作人员和现役军人,不得退出中国国籍。% V1 l/ a1 i7 |0 w+ M
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
: a! K$ B- A% M/ y 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
: |7 t/ s+ N. h! L 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。! H2 p7 }4 X; d1 }$ ` t
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
# e, R3 j' J* ~+ v 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

nationality of the People''s Republic of China.

The People''s Republic of China is a unitary multinational state; persons
: c! {( r k- i$ J% hbelonging to any of the nationalities in China shall have Chinese

3 v8 |6 I/ R/ YThe People''s Republic of China does not recognize dual nationality for any/ i4 o! K& }! G" K2 c0 F8 o
Chinese national.

4 @' v- R8 K* _5 r, O6 C- UAny person born in China whose parents are both Chinese nationals or one4 X3 m) l" y9 `/ d- f+ x+ i
of whose parents is a Chinese national shall have Chinese nationality.: r2 `& @4 H) e' \

Any person born abroad whose parents are both Chinese nationals or one of
, r$ J* ~2 t$ ?whose parents is a Chinese national shall have Chinese nationality. But a; K* h8 d, y2 G: O' A
person whose parents are both Chinese nationals and have both settled
Z; U; l$ v, H2 }5 Vabroad, or one of whose parents is a Chinese national and has settled
5 @1 [) p; v9 n1 ^. @, `1 e2 {abroad, and who has acquired foreign nationality at birth shall not have5 E: K0 u8 J. R) ^' i

0 g+ q- S5 m9 p! O. N5 aAny person born in China whose parents are stateless or of uncertain% d7 I4 T( Q- u+ m3 r7 |
nationality and have settled in China shall have Chinese nationality.

' v% k( e8 S' X vForeign nationals or stateless persons who are willing to abide by China''s2 @' X& ]" O, r- C, \) w
Constitution and laws and who meet one of the following conditions may be/ B( x% _: i( s1 {
naturalized upon approval of their applications:! k" ^; y) H0 D3 T$ y" \
(1) they are near relatives of Chinese nationals;
9 y9 t4 q9 W. N4 E, V(2) they have settled in China; or
4 X; j3 s. ?) g5 ?(3) they have other legitimate reasons.

" m/ t; }. x& w0 ZAny person who applies for naturalization as a Chinese national shall A# Y, I+ x2 R$ G% J7 R
acquire Chinese nationality upon approval of his application; a person
& i! e3 }% V: T3 M/ x3 {whose application for naturalization as a Chinese national has been
# @+ }% S& {- ]) |7 M9 t9 Z( `6 aapproved shall not retain foreign nationality.* E# T, x: O3 |9 {" F' u
Article 9' x1 Z. h' F1 B# d
Any Chinese national who has settled abroad and who has been naturalized
) h' Y6 |" T+ b0 T9 Has a foreign national or has acquired foreign nationality of his own free
' J) a2 V3 x# _. n' J# hwill shall automatically lose Chinese nationality.
& n1 [0 q+ K! e6 i/ }Article 101 t) k- \$ ^! L* S9 T3 A5 i: r: w
Chinese nationals who meet one of the following conditions may renounce
7 e$ b/ u5 N- s! j6 wChinese nationality upon approval of their applications: @: a* V* x+ X1 u9 h* a
(1) they are near relatives of foreign nationals;; o4 c3 R' Q, n% Q) @7 n
(2) they have settled abroad; or
/ S1 b/ C( r" ^(3) they have other legitimate reasons.

Any person who applies for renunciation of Chinese nationality shall lose
Q/ D! M8 w7 r+ ~5 g! f- cChinese nationality upon approval of his application.

State functionaries and military personnel on active service shall not
F5 ~4 Y3 V- Q! m. s- A7 P9 jrenounce Chinese nationality.
* _1 `; d% T x9 v' {Article 13
, ^+ P5 T; C# nForeign nationals who once held Chinese nationality may apply for
6 C& Q/ Z3 \4 [6 m3 V8 crestoration of Chinese nationality if they have legitimate reasons; those
0 r$ ~% n9 t( ]3 G. Bwhose applications for restoration of Chinese nationality have been4 G! C) i" I7 ]! z
approved shall not retain foreign nationality.+ K& |* a1 E& V- o' M
Article 14
: A2 S: g2 q- y3 MPersons who wish to acquire, renounce or restore Chinese nationality, with5 Z+ X: z" `8 Z
the exception of the cases provided for in Article 9, shall go through the8 V9 }$ ~0 r9 N: G9 x* @
formalities of application. Applications of persons under the age of 189 v1 K$ B" v9 T( M, {, `) d
may be filed on their behalf by their parents or other legal
% Q! D8 ~- A7 P5 D! N% t( vrepresentatives.. s3 d5 W6 U! N( R
Article 157 w$ p# o; c& b7 v) p$ C
Nationality applications at home shall be handled by the public security
3 m0 T$ u7 p9 M+ p5 ^! v, W$ x( ]: rbureaus of the municipalities or counties where the applicants reside;& `% e$ Y c! L- ~3 m
nationality applications abroad shall be handled by China''s diplomatic
$ _( C1 M- R; n- Y) [8 jrepresentative agencies and consular offices.
9 n" y L8 y* }Article 16
. K ~' {/ p0 A% |. ]. x: I, sApplications for naturalization as Chinese nationals and for renunciation
1 m C* s$ c. Mor restoration of Chinese nationality are subject to examination and
* D* [: V! v8 `9 Dapproval by the Ministry of Public Security of the People''s Republic of
. ?! I' V5 {, y7 \2 M/ {' TChina. The Ministry of Public Security shall issue a certificate to any
b/ C* B9 N! e; q2 i gperson whose application has been approved.
$ Y" r. m+ s7 F( p% rArticle 17, Y$ ~2 D% V' l$ B, x% V) C# s' h
The nationality status of persons who have acquired or lost Chinese
5 f# Q5 o* v4 j4 g) Enationality before the promulgation of this Law shall remain valid.# U% e( C: ?/ ^ H% G* r3 y0 z
Article 18
! J9 h/ B8 N8 h" p0 U6 q% rThis Law shall come into force on the day of its promulgation. |
