5 N. c2 l7 W1 n) L& t. f8 I/ B《中华人民共和国国籍法》   }' U6 d( c% n8 J- b2 r
 
0 s/ j4 Y  _( M 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
  o. p( M! f+ Y    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。# r( s- _9 Z) s/ U2 `
    第三条    中华人民共和国不承认中国公民具有双重国籍。
: [+ k! {9 [6 p1 L3 l% D8 J; c9 O3 Q2 ]    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。* Q% [7 d, |6 ~( N" \: k$ q
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
) s) n0 `, k* }8 p; W7 k4 W. W: ~    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
3 l1 {3 B8 R; K1 H0 T# N; ]8 i4 P    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
* a# |2 V) k* |, v7 E    一、中国人的近亲属;
2 V: r8 n& g  R    二、定居在中国的;8 ?. m8 L, T0 f% W+ _! G' D
    三、有其它正当理由。
5 Y* s; [% s- h  K$ U    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。. ^7 e1 k$ Z, k
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。4 T: C+ m- ^$ f4 m
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
% n# u! _: [3 J0 U+ K    一、外国人的近亲属;$ S+ D+ X$ m7 ~3 @+ E: T
    二、定居在外国的;* A: Y0 r) ^' Z* V+ C
    三、有其它正当理由。
7 g6 C0 c( e% b; H" ]/ u" B8 U    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。. K, J& h1 I( A) d! G9 ]
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
; A: d+ {/ L! o0 u    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。4 E3 w5 x+ T' R. l7 R7 w  n
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
9 v1 E5 k( A' m    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
- W3 k% p! y+ v) o    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。, y- c1 o3 N& J: X1 U* x8 e
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

' r! K6 f* ~  ]) u5 ]( cCongress, promulgated by Order No. 8  of  the  Chairman  of  the  Standing+ Z- g& ]. m2 Q/ o1 p: W- z* N
Committee of the  National  People''s  Congress  on  and  effective  as  of

This Law is  applicable  to  the  acquisition,  loss  and  restoration  of8 Y& ]0 Y% P. o# g
nationality of the People''s Republic of China.
) Z: H' ?$ D1 w3 e0 FArticle 2  w! N$ O; @4 |5 Y. T, B
The People''s Republic of China is a unitary multinational  state;  persons1 |$ }8 i  \. Y# d8 N
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese+ T5 `+ x& R2 [
nationality.+ R( P0 `" W* @: c. k" ~" q4 G$ D
Article 3
% V, l8 ~% R% {* x4 f( bThe People''s Republic of China does not recognize dual nationality for any: M' G; r4 ?( I/ a, N
Chinese national.
, p/ l: C) u* pArticle 4
7 Q; ^9 \4 f. _* p/ c; i+ Q7 S0 yAny person born in China whose parents are both Chinese nationals  or  one
6 C1 i* O5 ^6 C" w, bof whose parents is a Chinese national shall have Chinese nationality.
5 Y5 T9 |! ^+ f) ?& FArticle 5
0 F4 X4 e6 T$ P' r4 o& zAny person born abroad whose parents are both Chinese nationals or one  of
( h* x2 I% M' w: n4 Z3 b% hwhose parents is a Chinese national shall have Chinese nationality. But  a
* X$ ]8 u$ @& h1 e- L9 K, N' vperson whose parents are both Chinese  nationals  and  have  both  settled
  ~8 a3 z& B0 w( J) zabroad, or one of whose parents is a  Chinese  national  and  has  settled
2 G5 w) M1 J/ w: i! {2 T# y7 xabroad, and who has acquired foreign nationality at birth shall  not  have
7 }; ]. U* Z) l! H; L" l% s. `Chinese nationality.
2 L0 S* G2 f$ E6 R( O: y" R' ^Article 6' o) ~* i( e8 w1 ?* P& _  G, D6 O
Any person born in China whose  parents  are  stateless  or  of  uncertain7 ?% ^0 v2 M" ^* n) G+ O
nationality and have settled in China shall have Chinese nationality.( _5 v4 A, G. w) M8 V, M
Article 77 G8 {: P0 }5 a& }
Foreign nationals or stateless persons who are willing to abide by China''s
+ i* p/ a% }' W+ `. H5 Z8 zConstitution and laws and who meet one of the following conditions may  be  N1 k4 ?8 S1 M8 m9 U/ Y1 p1 t; O9 q7 F
naturalized upon approval of their applications:
1 s7 C0 m1 n5 t& s: A7 l* E(1) they are near relatives of Chinese nationals;
& r7 s. j, y/ c(2) they have settled in China; or0 W5 @7 V0 f: k$ f2 {
(3) they have other legitimate reasons.
( L" p. R% R7 {: @/ {- d1 ]0 M# ]Article 8! n1 I  z( u0 u# _- t; q5 q- w
Any person who applies for naturalization  as  a  Chinese  national  shall( x% N' c8 ], `* C) u" r, E
acquire Chinese nationality upon approval of  his  application;  a  person( t& C3 V5 I9 N( y+ [) k) g
whose application for  naturalization  as  a  Chinese  national  has  been
+ v) Y8 W; x; e4 N* |approved shall not retain foreign nationality.
* e! b5 p' b3 l, \! Y% z) p& qArticle 9: T( N2 y% k4 O% m+ F
Any Chinese national who has settled abroad and who has  been  naturalized
& ]( i* ]  i5 x  `. ?! C. {2 H6 j( Uas a foreign national or has acquired foreign nationality of his own  free
& v/ c" C0 K+ |$ k& Uwill shall automatically lose Chinese nationality.; d! O) o0 n5 n4 P
Article 10' K+ p  D( X3 v+ L; S) p
Chinese nationals who meet one of the following  conditions  may  renounce
+ O3 @: ]  N4 U0 `7 YChinese nationality upon approval of their applications:
- q* _6 O0 _0 H8 Q(1) they are near relatives of foreign nationals;- K; t5 t9 Q, D
(2) they have settled abroad; or- ?2 J5 k* O9 ?* Y- T* K* Z6 B5 ^$ [
(3) they have other legitimate reasons.9 c0 G4 R5 {- i/ C) [
Article 11+ Y; ^) e+ |5 L7 @; M. U$ Y
Any person who applies for renunciation of Chinese nationality shall  lose4 x6 A& w# P/ u& K. \" u: s- b/ R
Chinese nationality upon approval of his application.
3 S7 w( I  F8 A" uArticle 12& w1 d7 L  D5 o3 W, ?3 J
State functionaries and military personnel on  active  service  shall  not
. F+ n7 ]" z5 h* T% Irenounce Chinese nationality.
0 I# z( q- [, R" g& @Article 13- S: {- v7 h. y3 {1 \, D' b
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for- P$ @$ F2 b- p% I- Z& _2 T; A9 j+ ~
restoration of Chinese nationality if they have legitimate reasons;  those1 y% G1 _8 X+ e9 S+ n1 p# o8 l( ]% k
whose applications  for  restoration  of  Chinese  nationality  have  been
& W- t6 x7 u3 capproved shall not retain foreign nationality.
5 |9 z' `% I1 e* a! @; lArticle 14
6 o/ M3 ?: Q# g" r' wPersons who wish to acquire, renounce or restore Chinese nationality, with% c1 f; B  h4 w
the exception of the cases provided for in Article 9, shall go through the2 c. V5 u! P+ W: k6 p' i; o8 E0 K
formalities of application.  Applications of persons under the age  of  18- D3 q4 U' b1 H0 T! x
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
- c- q6 |" i1 l; ~+ D! zrepresentatives.
; U5 M( F8 M& ?Article 15
$ a8 ?  m% t0 i+ wNationality applications at home shall be handled by the  public  security
+ S, p+ o: Z; H2 T/ V& L8 bbureaus of the municipalities or counties where the applicants reside;
% V6 a* g4 P# {/ ]: Knationality applications abroad shall be  handled  by  China''s  diplomatic' y; g1 C  K9 d  W
representative agencies and consular offices.5 Q& v4 U7 G% J6 n2 W, m3 o
Article 16
  F  r* @8 }& Y/ `" J1 ^) p6 V3 q5 hApplications for naturalization as Chinese nationals and for  renunciation' C7 b9 I8 c. t$ u
or restoration of Chinese  nationality  are  subject  to  examination  and
$ |! r% p5 f  h/ D0 s# ^# A- W% oapproval by the Ministry of Public Security of the  People''s  Republic  of
. E$ x( K  t9 D1 t0 V9 \4 BChina. The Ministry of Public Security shall issue a  certificate  to  any) R" ]3 `+ F( k' M" I
person whose application has been approved.
5 O" e, s) A+ a5 ^- S% ]* o5 `Article 17
/ [6 ^. P1 ~7 @- j7 LThe nationality status of  persons  who  have  acquired  or  lost  Chinese
% q* E* ^$ F/ q- }# u/ q: t5 gnationality before the promulgation of this Law shall remain valid.' Q6 M5 S. U# r6 g) `
Article 18
( `/ H$ d5 H/ J+ AThis Law shall come into force on the day of its promulgation.
