1 F' Y. m; U8 ~ 
* T$ C: ~9 Y( O$ N0 ?5 g2 i 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。& c# a+ b; T, h( a
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
6 u" [6 G+ g* P2 E$ d    第三条    中华人民共和国不承认中国公民具有双重国籍。
, u7 G$ N% {5 b4 G) c3 ?6 v    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
8 `# M6 }( r% u& L    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。2 Z5 B5 M5 }, e7 k) S
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
2 r% _9 K7 U  o$ C7 a    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
4 p3 }& ~: b' D1 r    一、中国人的近亲属;: H- y2 F% \0 E, B5 Q! n. H
    二、定居在中国的;
; i$ c  g  t- e    三、有其它正当理由。7 S7 [; W; w) J. [, F3 {
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
, L+ H8 f# [1 e# u# L    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。( A& x! A1 D9 k5 K' h! Y
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:# W- u' p. d4 s" L
    一、外国人的近亲属;
5 M0 C! ^* I0 ?. k) o* q! R    二、定居在外国的;/ a$ i1 j9 g- K( B, N/ h
    三、有其它正当理由。0 \. R% b. f9 l, y4 Q6 r9 c
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
* ], s, R- @. Y+ C9 c/ F% C    第十二条   国家工作人员和现役军人,不得退出中国国籍。, q7 f9 c3 m" u- B
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
) D/ u. ?# X* O3 A  r: q    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
* A4 O, f" [) Q% W    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。% g# d. |8 I4 O4 {0 |
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
, T; y7 r; V) b  b    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

+ e" `9 ]$ F* V1 M% ECommittee of the  National  People''s  Congress  on  and  effective  as  of
1 m! G+ s* C" s  C( ]% j8 nSeptember 10, 1980)
9 ^3 e5 `, _2 s5 f6 M6 x0 wArticle 1
4 V$ T# w( H, |+ }This Law is  applicable  to  the  acquisition,  loss  and  restoration  of
+ T  G- {+ J: r- D1 v* ~, Gnationality of the People''s Republic of China.
4 ]' y4 Z; u7 {6 NArticle 2, d4 ~- z- M0 G
The People''s Republic of China is a unitary multinational  state;  persons
0 E" y! j# Q+ u) ^belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
5 g! ]* V* |0 l" Knationality." p) r/ ~; b. K- R- D  K$ @- j
Article 3
4 Z$ n. V! n( K2 e2 O0 D  K7 sThe People''s Republic of China does not recognize dual nationality for any$ ?* ~: I  \1 V- O- F3 c
Chinese national.
7 F9 p) x- \) t; {Article 4
3 y! b+ l$ W# ]; `( ^Any person born in China whose parents are both Chinese nationals  or  one6 v) t3 X, @. G3 ?- h# J! a" F
of whose parents is a Chinese national shall have Chinese nationality.. W# B& ?  Y$ H8 g& u" U
Article 5
0 q4 Y. y% K: \: ?4 u4 x% ~Any person born abroad whose parents are both Chinese nationals or one  of
' w# o% Q: z8 C! y5 D: G7 ?whose parents is a Chinese national shall have Chinese nationality. But  a% |8 M* m. }& R2 Q# r( n
person whose parents are both Chinese  nationals  and  have  both  settled. V/ E( ?0 I4 A, ?
abroad, or one of whose parents is a  Chinese  national  and  has  settled
+ T7 l) L+ X& _3 r" Z& Dabroad, and who has acquired foreign nationality at birth shall  not  have
$ @# G9 j+ d+ U3 r7 Z1 c& {' D6 n( QChinese nationality.' _  P% R5 d/ ~8 ]) m
Article 6
# [: |0 X, Y, k# JAny person born in China whose  parents  are  stateless  or  of  uncertain
/ q# s( L* I- |, tnationality and have settled in China shall have Chinese nationality.- d2 u1 {9 V" b( \
Article 7# Y  l3 e3 I5 @- ?8 f
Foreign nationals or stateless persons who are willing to abide by China''s
! T  f0 |* _- c4 fConstitution and laws and who meet one of the following conditions may  be. f' l& ?+ ?' B- O; ^7 b
naturalized upon approval of their applications:
3 L. K' A5 Q) `/ P( {3 x(1) they are near relatives of Chinese nationals;- r4 I( k2 c1 E) S' ~
(2) they have settled in China; or
: X- x; \( W# t  m(3) they have other legitimate reasons./ g' p. b1 A: S8 r; i! [4 |+ _8 X
Article 8
, S: q# U. t: G( ?# B% cAny person who applies for naturalization  as  a  Chinese  national  shall. v' m4 U3 t3 Z. _% A3 E
acquire Chinese nationality upon approval of  his  application;  a  person# G& D  R/ B- B: p- R
whose application for  naturalization  as  a  Chinese  national  has  been2 e' {& c3 p5 o( N; T+ m5 v
approved shall not retain foreign nationality.
2 A7 T$ d( G7 W2 B6 @Article 92 o7 m9 q4 F& z! Z
Any Chinese national who has settled abroad and who has  been  naturalized/ o& z8 J* ]( Y- l, ^# L8 l
as a foreign national or has acquired foreign nationality of his own  free1 `$ e2 V. E0 i% r
will shall automatically lose Chinese nationality.
/ ^7 o, b6 r, V# }& D( ~Article 10  j3 [% L! G3 R: n0 {' a
Chinese nationals who meet one of the following  conditions  may  renounce
; }2 {* c6 B( V& b) {$ UChinese nationality upon approval of their applications:2 X; T0 V- E* k1 M
(1) they are near relatives of foreign nationals;! J5 u- g" `+ b1 @
(2) they have settled abroad; or# T/ T$ K# f* ]( k
(3) they have other legitimate reasons.3 b0 v; W9 M: p% A) b& X
Article 11
& ~  `/ G! i2 L9 q4 r  K, H( J. OAny person who applies for renunciation of Chinese nationality shall  lose, l8 i7 J) c8 P
Chinese nationality upon approval of his application.2 k9 W+ [6 x5 ~& e. A
Article 12
0 x# y$ H( q5 w# V6 k& d: N5 y9 YState functionaries and military personnel on  active  service  shall  not8 X) J$ @1 O1 T* x
renounce Chinese nationality.
7 _! p; q& p- M' iArticle 13" K$ j# _* E+ B! J$ o
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for. X+ r! K& _8 f) p5 a0 I% ]6 R
restoration of Chinese nationality if they have legitimate reasons;  those
6 e) C+ A7 M+ O$ |whose applications  for  restoration  of  Chinese  nationality  have  been* N6 K0 M# o. b8 C
approved shall not retain foreign nationality.
4 D2 \5 ~( F) B* h" zArticle 149 }, K, g5 O+ _4 C: ~0 T
Persons who wish to acquire, renounce or restore Chinese nationality, with
% v) v& X6 N; x- Othe exception of the cases provided for in Article 9, shall go through the
/ R9 Z. X/ ?! E( C# g! m$ F# zformalities of application.  Applications of persons under the age  of  18+ C8 Z. j; @7 _% d
may  be  filed  on  their  behalf  by  their  parents   or   other   legal2 ~" O& O$ B* w. Y0 Q
representatives.- o# H* z* I( t& Z. ^, n
Article 15  L' ?/ m' T0 R# y# G- q5 M2 H2 H  {
Nationality applications at home shall be handled by the  public  security' C) S3 J( o% e* l# M) Q
bureaus of the municipalities or counties where the applicants reside;
3 M# W/ Y- J. K! Anationality applications abroad shall be  handled  by  China''s  diplomatic9 S0 q$ K' H6 m6 T2 \) J
representative agencies and consular offices.2 g+ a$ J) p8 q; d
Article 16
5 C& Y( _/ S% L! c" qApplications for naturalization as Chinese nationals and for  renunciation7 z8 j. u1 u/ m' S& ^/ _
or restoration of Chinese  nationality  are  subject  to  examination  and
6 J+ ~6 U& ]* p$ k2 mapproval by the Ministry of Public Security of the  People''s  Republic  of+ i9 k" ^3 S2 z# u1 b" w! e
China. The Ministry of Public Security shall issue a  certificate  to  any
( x( m9 D4 X# h% t8 xperson whose application has been approved.
: n( o5 c1 w6 V! n0 A8 \Article 17& k1 u& f6 n' ]; J) a: g" h
The nationality status of  persons  who  have  acquired  or  lost  Chinese& U: O# ~9 `% l4 p
nationality before the promulgation of this Law shall remain valid.' s: X0 @1 s1 r' \
Article 18) L+ Z) w1 D7 J2 |& N4 A) E, ~
This Law shall come into force on the day of its promulgation.
