《中华人民共和国国籍法》 ( v/ C3 G$ c' W0 S5 u3 C Y
5 I) t. ^6 w9 r' M0 N" L' P( z 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。8 k Q: K2 `& a) L
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。: B( y* I6 i4 {# J* c
第三条 中华人民共和国不承认中国公民具有双重国籍。
0 V% R Z) }: R! y/ F 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。/ I: h0 D2 @( c' c+ I$ A
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。

" L! {* L2 A4 {- j 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:. T9 h" y! }! A# V- k* J) o
一、中国人的近亲属;

三、有其它正当理由。
5 ^2 ]5 ~, n$ \7 j0 P. o/ N( H( q 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
5 V8 E3 ~( b, N* T4 Q8 H" [2 @3 v 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。' O; f* @0 I i2 N& J
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:

二、定居在外国的;

第十二条 国家工作人员和现役军人,不得退出中国国籍。: g8 [# T2 g$ S' Z' M
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
+ L* b. W1 \: k2 z 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。. Y0 K% g0 n6 e, _/ Q3 k' g
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。! `8 X g+ q) _1 d
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

belonging to any of the nationalities in China shall have Chinese' x" D* d% L) _+ ]* S

Any person born in China whose parents are both Chinese nationals or one2 R9 {8 t+ f7 \- Q! m
of whose parents is a Chinese national shall have Chinese nationality.

Chinese nationality.

Foreign nationals or stateless persons who are willing to abide by China''s, D. E# j, L8 B& o' u
Constitution and laws and who meet one of the following conditions may be7 y8 Q: {' q( k" J
naturalized upon approval of their applications:; j- z8 |% |4 v, L
(1) they are near relatives of Chinese nationals;
7 L( _: [2 n* d% e$ k5 B$ P(2) they have settled in China; or) \% y! b$ x- I D) ?2 a
(3) they have other legitimate reasons.

Any person who applies for naturalization as a Chinese national shall* k: E b" K m$ m4 Z/ l
acquire Chinese nationality upon approval of his application; a person5 s$ S( p; K+ t: ]6 c& |
whose application for naturalization as a Chinese national has been
2 v8 @) \+ A0 F3 rapproved shall not retain foreign nationality.7 z9 C: Q7 i( v4 j
Article 97 p. t' ~/ J" V8 f
Any Chinese national who has settled abroad and who has been naturalized
" r6 N9 o2 z5 i0 f7 Qas a foreign national or has acquired foreign nationality of his own free
. O! H, e5 [2 U, C; ?" L$ m0 L, \will shall automatically lose Chinese nationality.

Chinese nationals who meet one of the following conditions may renounce
* e7 I7 M. M; G# _Chinese nationality upon approval of their applications:% g/ L# f2 a9 ^$ n5 z8 J' c
(1) they are near relatives of foreign nationals;
y2 W3 v. k* e R( w(2) they have settled abroad; or: X" B1 `. ~2 e5 `
(3) they have other legitimate reasons.

V5 e( I5 ^7 kAny person who applies for renunciation of Chinese nationality shall lose
( g9 e4 Z! J1 K2 w$ U5 z$ A- NChinese nationality upon approval of his application.

l! {$ ^9 J! g6 R; x2 uState functionaries and military personnel on active service shall not6 X4 g' n5 a7 }; b0 B/ s+ M
renounce Chinese nationality.
5 j# K' Z) |: w& ]Article 13+ Y2 G6 Z {: Z1 M% ^. S
Foreign nationals who once held Chinese nationality may apply for
$ v( j# L/ Y" Trestoration of Chinese nationality if they have legitimate reasons; those
9 r+ E3 `- [" D5 z2 x1 uwhose applications for restoration of Chinese nationality have been
- {% W* B1 \; Y6 n3 Q6 U$ g$ fapproved shall not retain foreign nationality.0 Y5 o+ v0 b$ q! {' S
Article 14
- M R1 B1 S/ ~) ^4 Q8 N- l7 yPersons who wish to acquire, renounce or restore Chinese nationality, with
( N J! b8 m# \7 O d( Gthe exception of the cases provided for in Article 9, shall go through the, ~: h9 U4 H7 u% Q- p
formalities of application. Applications of persons under the age of 18) ]# {$ N$ S; U3 l& u( ]! V
may be filed on their behalf by their parents or other legal
% t9 @) G- z$ C6 V: l0 urepresentatives.5 Q! h# I$ }+ k8 N

Nationality applications at home shall be handled by the public security0 a1 ^" Q( V/ _% s" T& J. Q2 P
bureaus of the municipalities or counties where the applicants reside;
E6 ?/ ?, S& J: L. g. U& unationality applications abroad shall be handled by China''s diplomatic
) `0 M5 Z& g( A- W7 f2 Frepresentative agencies and consular offices.3 x" ^0 H. l; m/ N5 s$ M# u9 _! V
Article 16) M3 |4 Y; k! t+ w: s/ I
Applications for naturalization as Chinese nationals and for renunciation
. ~" u* n; ?: For restoration of Chinese nationality are subject to examination and* P: k3 D$ o+ y' X3 \
approval by the Ministry of Public Security of the People''s Republic of
6 X1 i+ g, Y3 LChina. The Ministry of Public Security shall issue a certificate to any0 v+ R @ c+ C3 B2 O
person whose application has been approved.

9 b' A! u" N: X" HThe nationality status of persons who have acquired or lost Chinese+ s0 \' r5 q% W0 i2 J8 G' h
nationality before the promulgation of this Law shall remain valid.( M6 `6 Z+ h. G/ n* A! }5 I0 q3 R

This Law shall come into force on the day of its promulgation. |
