中华人民共和国国籍法(附英文)

第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
) A  t/ ~" y( I% S( H1 w    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
0 F" y* S9 ?3 I% J    第三条    中华人民共和国不承认中国公民具有双重国籍。0 G$ n5 Q  A' Z/ ?& G  B$ s5 ?/ e/ j
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。7 c  h$ w2 l/ l0 C7 E5 F, Y
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。8 K1 g8 N0 g. j# s
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
/ p# M9 q- h5 p7 Q. U) q+ l8 g" d    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
- n' X* ?: l! m, K& ^, j0 H2 {    一、中国人的近亲属;
7 r9 w/ R2 U( |, B' \1 h' ~    二、定居在中国的;2 ^5 d, G) E* V7 j8 F0 t: g
    三、有其它正当理由。( n' Y: m) G0 h
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。4 ?3 A2 L: ~6 a
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
- }' B* F* r2 @) R    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
/ X4 G; }# s' w" b    一、外国人的近亲属;; L9 p- Z% q, f3 G% j( K
    二、定居在外国的;. h5 C9 ]2 V* q! X  ?
    三、有其它正当理由。& d3 u4 C9 i6 x5 V. b" `
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
4 U" U! v( v0 |! }* b! }" J5 C+ ]    第十二条   国家工作人员和现役军人,不得退出中国国籍。- G$ a! h8 w; d+ N/ m7 F4 Q
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。% L$ h- Q+ F4 }" o/ F7 t2 W
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。, L" l) ]( s$ F' l& u
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。% p. c8 o( s7 V0 G  [
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。  e5 P! U$ |; r3 [8 v6 N- x
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Article 1% ]1 V9 b- `) a+ V: j1 g
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of- v/ _' I) {$ Y$ p
nationality of the People''s Republic of China.6 _& E6 j, V  I  O5 a* Q" ^
Article 2
9 V/ x8 `: U! ^, `8 h9 |! QThe People''s Republic of China is a unitary multinational  state;  persons: }# d- c8 f5 ~, C$ o
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
4 H/ t3 c1 W& n# ~9 K) o/ G$ }nationality./ i  V8 Y3 m" s( Y! a, J% x
Article 3; z) e+ _3 v* x( Q. ~
The People''s Republic of China does not recognize dual nationality for any
8 U3 x* e8 N/ W! ~* kChinese national.
( v, H' _/ R( Z8 @; zArticle 4! N7 h. x8 ~. s% l- b" h9 V6 x! F
Any person born in China whose parents are both Chinese nationals  or  one; z7 c7 N7 G: n
of whose parents is a Chinese national shall have Chinese nationality.

0 [5 _$ P5 {# C  ]/ X4 S% |Any person born abroad whose parents are both Chinese nationals or one  of: J. y2 f( Z" x" _* g: g/ Y9 k) r
whose parents is a Chinese national shall have Chinese nationality. But  a7 X0 {9 X! m# [, O. A: U) l
person whose parents are both Chinese  nationals  and  have  both  settled& N' N1 y6 g& D4 j/ [# F$ I% }
abroad, or one of whose parents is a  Chinese  national  and  has  settled5 e  r4 U5 U8 M' V: Q$ \0 G
abroad, and who has acquired foreign nationality at birth shall  not  have
/ S1 ]+ y! l. Y- c/ |" mChinese nationality.0 r5 G; j8 e6 C" D2 S$ e
Article 65 {  L( v) R. u& Y+ g; X
Any person born in China whose  parents  are  stateless  or  of  uncertain3 G6 X' _: \8 h$ X7 y7 \/ W! V
nationality and have settled in China shall have Chinese nationality.
- G' d! ~5 _9 Y$ K# K5 c) lArticle 7$ `& t' l& O8 Q0 b$ a; \$ u
Foreign nationals or stateless persons who are willing to abide by China''s
: W/ e! j5 N3 h7 U2 `Constitution and laws and who meet one of the following conditions may  be
& K6 V: x3 g& U  [/ |naturalized upon approval of their applications:1 O9 X6 g/ z6 B! w( [' j
(1) they are near relatives of Chinese nationals;
) K8 F. a# y+ L+ J7 M9 r! P(2) they have settled in China; or9 Q1 G. ~$ T8 T$ [
(3) they have other legitimate reasons.) O+ z. J; R% a1 k
Article 8* c' Q5 W; s# x7 T5 t
Any person who applies for naturalization  as  a  Chinese  national  shall! B& T) t' L( o" F: R# o" C& g
acquire Chinese nationality upon approval of  his  application;  a  person/ s) M$ t/ }! F1 }7 A9 J) q$ p
whose application for  naturalization  as  a  Chinese  national  has  been* K! ]) F+ D$ U: k" v3 t/ G3 `
approved shall not retain foreign nationality.* E4 h5 j- O5 `3 b
Article 9  ?6 y7 }/ @$ O, o+ X2 _$ b
Any Chinese national who has settled abroad and who has  been  naturalized- z6 m. K1 l# s9 I8 a: b) {
as a foreign national or has acquired foreign nationality of his own  free( y0 }& M3 N9 r; S! I# }
will shall automatically lose Chinese nationality.
4 ]  f9 o! o) @Article 10
- [/ [4 d2 Y+ G( |9 f6 ~# ]# u+ TChinese nationals who meet one of the following  conditions  may  renounce8 z' U5 ~( T  ^' o) h
Chinese nationality upon approval of their applications:
4 q7 W2 S6 z) m(1) they are near relatives of foreign nationals;. D# [1 x6 q6 j0 |% L! h+ M0 J) Y7 o
(2) they have settled abroad; or
! T/ [  \- O$ K(3) they have other legitimate reasons.8 N2 J6 i( B- y3 \
Article 113 f7 e( {5 h1 F+ g5 p
Any person who applies for renunciation of Chinese nationality shall  lose
( f1 n5 @5 `# o. tChinese nationality upon approval of his application.
: J% d% \& W4 s2 v9 s0 bArticle 12
* v0 R$ u4 y3 ?4 o& nState functionaries and military personnel on  active  service  shall  not% g* E# r7 r- G% F, M% \6 j
renounce Chinese nationality.* m4 [, d0 V! J6 r! x
Article 13
' w" }$ S' D& o3 }! \% VForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
& B  z6 K. x) Z- [5 g  erestoration of Chinese nationality if they have legitimate reasons;  those& ?9 y8 i4 B$ u/ L8 N. r! {& g  U
whose applications  for  restoration  of  Chinese  nationality  have  been3 p6 a" r$ w5 ?$ C( m% h* E% d
approved shall not retain foreign nationality.4 w! W; U# E# d1 @- O0 B
Article 149 t) ^' t' d. `, v: w. o: L2 `$ P- G
Persons who wish to acquire, renounce or restore Chinese nationality, with
# S- h1 y$ q; w8 ?the exception of the cases provided for in Article 9, shall go through the/ G# T! O5 M( _. A3 L6 s8 B
formalities of application.  Applications of persons under the age  of  18
+ A. g1 u8 X9 Umay  be  filed  on  their  behalf  by  their  parents   or   other   legal
3 d0 }5 M- Z) q+ {( ^5 Jrepresentatives.
9 W* E3 T- y$ L0 t; SArticle 157 h: s6 j$ D3 z; q7 Y& A$ W8 T
Nationality applications at home shall be handled by the  public  security
0 i+ r' ?+ L3 v# }  jbureaus of the municipalities or counties where the applicants reside;
1 K$ p( O/ r, i0 _4 @# \nationality applications abroad shall be  handled  by  China''s  diplomatic. A$ _( a& ^+ E9 J
representative agencies and consular offices.
. Z, f, K* G; v4 H; ]- PArticle 16& m/ B. Q, V; j3 z1 d1 U2 D+ g
Applications for naturalization as Chinese nationals and for  renunciation
/ c& e5 o' {+ X) r' [% yor restoration of Chinese  nationality  are  subject  to  examination  and6 u0 ~) I; }1 P' B7 ^9 ]( @
approval by the Ministry of Public Security of the  People''s  Republic  of
) `; [# z1 W5 n$ f& t0 D/ S- YChina. The Ministry of Public Security shall issue a  certificate  to  any2 d2 ]! K" V; q* Q
person whose application has been approved.
6 N8 y6 e2 [1 ~' o6 Z$ qArticle 17. \0 [' ]3 o# w4 B; g8 M# _  t/ X
The nationality status of  persons  who  have  acquired  or  lost  Chinese! a- x: g1 G/ i+ z. ?" V
nationality before the promulgation of this Law shall remain valid.+ y* _7 x0 w+ ^
Article 18
  L* s- I7 \) M0 o& l2 [This Law shall come into force on the day of its promulgation.
