第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
- h3 ?  P7 s1 i    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。' m% q+ b; s" e# H: k8 j2 j
    第三条    中华人民共和国不承认中国公民具有双重国籍。& N6 q# t5 g9 \1 X0 \
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
4 |2 N. z: f) J4 D0 u    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
9 D" r( @  X7 w: k6 U" W0 W    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
3 N4 t% ]6 r% @0 z: s' q4 C    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:2 t0 T/ J' F! l' m* E6 ]
    一、中国人的近亲属;  N0 r# K, U5 Y0 k: N5 q1 T& C0 a1 [
    二、定居在中国的;
, d/ h' V7 |$ P$ |2 X    三、有其它正当理由。
5 ?% B1 Z2 r) m, L' T6 {# c% v    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
6 d+ `: G5 Z7 ^0 I    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
! }7 Y9 Y6 O5 N; J* D" X8 h: M    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
/ d5 [8 w% Q! s; w  b9 B    一、外国人的近亲属;! t* c: l0 j2 M' ^+ g
    二、定居在外国的;
3 o7 @) Z1 h% L6 t    三、有其它正当理由。
. P% s2 n5 B0 o3 A; W3 g) Y    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
% o4 F; m( g8 E) w4 @    第十二条   国家工作人员和现役军人,不得退出中国国籍。
. ?* I, c* w. r0 e    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
/ W) Y4 z+ a5 Z3 d    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。* d; g. k' g( G% [
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。- a, @. x$ u) t6 p
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。# K8 `7 J3 ]) I8 f
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。  ^& i, K8 Y+ H6 Q
    第十八条   本法自公布之日起施行。

Committee of the  National  People''s  Congress  on  and  effective  as  of

; C! R! h. y: @: y! r, s5 XThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of- Q' z" K- o. b8 a
nationality of the People''s Republic of China.- u+ p2 u) ?8 q9 j( m
Article 2, d7 }5 p5 R" d; r: D) v
The People''s Republic of China is a unitary multinational  state;  persons
/ K; {0 r( j8 Rbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese3 q$ T5 i$ ~% s, ?2 I+ f: K! n
nationality.0 t, b- @8 T6 J
Article 3
% a& c" R' |2 n) H  `The People''s Republic of China does not recognize dual nationality for any- }1 }3 |* v, E( ?( }
Chinese national.5 l7 n" F( y6 U' w* T' n2 }2 N
Article 4# Q( y3 E! Q2 w7 V8 g
Any person born in China whose parents are both Chinese nationals  or  one- B, w4 o4 s  d- {+ f* ~
of whose parents is a Chinese national shall have Chinese nationality.  O* }; v* J  _% M8 O3 C& S. R
Article 5
/ W1 X- U: m) I% f3 _5 YAny person born abroad whose parents are both Chinese nationals or one  of6 i2 N( Y; b4 R% h
whose parents is a Chinese national shall have Chinese nationality. But  a; ^% `2 U  U$ l% v8 d
person whose parents are both Chinese  nationals  and  have  both  settled
5 K" b" g% q$ c: Zabroad, or one of whose parents is a  Chinese  national  and  has  settled
/ N. U- ~4 L% F! dabroad, and who has acquired foreign nationality at birth shall  not  have
  U& q' E  ~: [0 c' LChinese nationality.
$ d' V9 W/ D: n9 e/ l: J) i* aArticle 6
- d5 ^& A: U7 KAny person born in China whose  parents  are  stateless  or  of  uncertain
1 [3 @: e9 o5 b4 Qnationality and have settled in China shall have Chinese nationality.0 T' J( {2 @( A. A: ~2 q( T; U) ?
Article 72 [* C( h; E6 ^3 V  T8 T
Foreign nationals or stateless persons who are willing to abide by China''s
+ v( B& ]- l8 x4 b* rConstitution and laws and who meet one of the following conditions may  be
8 H  m( d- }- q( B6 c" cnaturalized upon approval of their applications:, D; a2 Z4 R3 B5 S$ r+ n3 }& ^
(1) they are near relatives of Chinese nationals;4 x1 T( Y# [" h1 J) r
(2) they have settled in China; or1 ?8 Q% t4 n) W7 g; ]) K; B3 O# g
(3) they have other legitimate reasons.
! e5 I( v$ v$ ]+ B" zArticle 8
$ w& s' m6 r& w% N; P; E; f; dAny person who applies for naturalization  as  a  Chinese  national  shall
+ g2 i: }. W) gacquire Chinese nationality upon approval of  his  application;  a  person
/ H- m3 q6 R' h* u% A5 i, g4 [whose application for  naturalization  as  a  Chinese  national  has  been( P9 Z6 V; u' r" D) {
approved shall not retain foreign nationality.
; Z' D: l; R; O4 B; @) [6 b  m& W, |* |Article 9
% d6 C' y5 F8 mAny Chinese national who has settled abroad and who has  been  naturalized
5 r/ J+ d5 ?2 x7 Uas a foreign national or has acquired foreign nationality of his own  free9 o1 ]* y+ l4 \' o4 j5 t+ h( r6 U1 e
will shall automatically lose Chinese nationality.
, f# p' g' f4 ~5 g3 cArticle 10
) n/ W6 a7 s! l* C. D6 TChinese nationals who meet one of the following  conditions  may  renounce" E2 o9 u4 g; n0 y
Chinese nationality upon approval of their applications:1 ]7 L0 w* X& b- j) A9 c5 z3 D1 p
(1) they are near relatives of foreign nationals;8 L3 ?' A4 t' a0 {
(2) they have settled abroad; or
% j1 M4 J" y( K6 g(3) they have other legitimate reasons.5 Y: y+ A) K/ h/ }6 j( h: F, B
Article 11
# x+ J+ G: c1 n9 |! WAny person who applies for renunciation of Chinese nationality shall  lose* O1 c7 z* Q1 T. T4 n6 m
Chinese nationality upon approval of his application.
( H% l# g* s* K) I7 _Article 12* v8 m! e& X5 [1 \! Z+ i& y
State functionaries and military personnel on  active  service  shall  not
( R; K* t, W- V7 C& Orenounce Chinese nationality.* ^5 S; t( c- K: a" U5 P+ C
Article 136 r9 ]- q, i) d9 }4 W$ O
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for
6 H; {! @/ {  P0 W( _1 Hrestoration of Chinese nationality if they have legitimate reasons;  those. j/ J7 x2 V& y
whose applications  for  restoration  of  Chinese  nationality  have  been
" d* p- e; |! A' A( w1 lapproved shall not retain foreign nationality.: ?2 N9 s( L' {
Article 14
* g0 s; V* E) E+ e& @6 G3 iPersons who wish to acquire, renounce or restore Chinese nationality, with* z6 T$ p5 i9 p& @
the exception of the cases provided for in Article 9, shall go through the
, C1 h& x9 j6 H7 q- mformalities of application.  Applications of persons under the age  of  18+ Y8 {! P9 J' r* V7 k4 T( m
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
5 E% e( c9 g' R/ [representatives.
- y; q; U  y& B  ~7 mArticle 153 j$ R/ D9 I  T9 r; v
Nationality applications at home shall be handled by the  public  security
% ^) g+ W' ?% L' sbureaus of the municipalities or counties where the applicants reside;9 W/ w) }3 B! Z) h' u& L7 B% Z
nationality applications abroad shall be  handled  by  China''s  diplomatic
6 W! h& C. x  V3 O0 Hrepresentative agencies and consular offices.
8 {. U5 d" U1 M3 B, nArticle 166 c. Y7 h- H. c' E
Applications for naturalization as Chinese nationals and for  renunciation
, N* X( _. a! s1 ^or restoration of Chinese  nationality  are  subject  to  examination  and/ O4 I3 T' F9 i
approval by the Ministry of Public Security of the  People''s  Republic  of
/ N" S9 o( W& x* `China. The Ministry of Public Security shall issue a  certificate  to  any& W2 R& d( p$ X; B, y
person whose application has been approved.

) d, b* ?( G" M* g( EThe nationality status of  persons  who  have  acquired  or  lost  Chinese/ t7 Z2 ]" Z, c5 g, J
nationality before the promulgation of this Law shall remain valid.7 I, a9 R* C9 G, y4 X
Article 18- |5 v, ]! d9 D( ]* |' y/ R
This Law shall come into force on the day of its promulgation.
