求帮助，中国博士后（非移民）的税务问题

被税务局要求补缴以前博士后（没移民，也没申请）收入的税，理由是居住在加拿大，所以中加税务treaty不适用。哪位有经验与税务局argue的，或是觉得有那些条款可以反驳的，请不吝赐教。先谢谢了。

是指你的grant 的收入吗？还是指你的全球收入？

Payments which a student, apprentice or business trainee who is, or was immediately before visiting a Contracting State, a resident of the other Contracting State and who is present in the first-mentioned Contracting State solely for the purpose of his education or training receives for the purpose of his maintenance, education or training shall not be taxed in that Contracting State.

会楼上各位的，是Scholarship收入，T4A。
税务局的理由是虽然是没有移民加拿大，但是居住在加拿大，所以Contracting State 应为加拿大，需要缴税。
如果按照这个解释，没有任何学生，博后或访问学者可以免税了。

按照解释，你来加拿大做博士后之前，是在中国居住的居民，做博士后其间没有申请移民，就应该可以免。建议去Canada Place那里咨询并要求要一份Article 19。

那天看一个tip sheet上写的，resident for tax purpose和resident for immigration purpose是不一样的，只要你在加拿大拥有财产（比如家具。。。）在算税的时候就算是居民
