i believe if you still want to raise the rental rates, then you'll need to have it in writing 90 days before it kicks in. but from what you're saying, you no longer want this tenant to stay at your property. in such case, I believe you still need to give him 1 month notice to move out (even if the contract has expired). during this month, the rental rate will remain the same as it was for the contract.
It a fixed term so the contract ends as the stated time/date, plus it says on the contract: no notice shall be required of either the Landlord or Tenant to terminate the tenancy at the end of th efixed term. You have the right to tell me move out, no written notice is needed. The problem is if he doesn't move out, it's very hard to deal with because you can not touch him physically... Can I take the police with me?
the police will not get involved as this is a civil issue, not a criminal issue. they will only get involved when there's physical contact made resulting in injuries (ie fights or such). in your case, if you really want the tenants to move out, give them 30 days notice, if they still don't move out, go to the city hall, purchase a must vacate notice, and give it to your tenants with 24hrs notice. after that, you can call those people to force a move (at a fee) if you like. I would not recommend it as your tenant obviously know where your rental house is (houses cannot move, ever). so they can always come back and damage your rental house. / z f7 R( J2 L5 c+ p
