: N" l1 g! q5 s3 W5 z: r$ D* m 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
' s ?7 _5 W% @( J k* K 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
- {5 S8 {& n, h8 ^: J& d0 H: z 第三条 中华人民共和国不承认中国公民具有双重国籍。2 | b! Z/ t! @' `3 G7 C7 z
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。6 u( D* d& Y3 Q$ c4 I7 L+ g- i
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。& X8 K2 x$ [- b( I6 G
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。. Z( N- G" S- D. a% k) p
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

二、定居在中国的;
# }2 f# t6 ]7 X: p 三、有其它正当理由。
I% f: ]" k7 z0 q9 V 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。: S0 e; @6 X: m2 Y6 H4 M
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
' J [( C4 O% O L& M 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:' j$ b7 K. [' R2 U. k' [9 r
一、外国人的近亲属;
7 g5 {$ I" C7 r 二、定居在外国的;
# Z' e9 T% ^1 K* S# }0 D0 `8 [/ p 三、有其它正当理由。

第十二条 国家工作人员和现役军人,不得退出中国国籍。* h" C3 \% z# O( E
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
) `; ^. g% n: d7 s2 K! G1 ^ 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。7 \, L3 U3 I* _ g! l! V6 x
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。/ k2 S! `4 |& P0 L; ]" L
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。' j8 A/ c! J- D3 G
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Article 2
; m) j9 t; j" E9 Q8 C4 H6 X, a$ QThe People''s Republic of China is a unitary multinational state; persons" I. @# v+ l3 @8 t0 s- O/ l" | C
belonging to any of the nationalities in China shall have Chinese

of whose parents is a Chinese national shall have Chinese nationality.

Any person born abroad whose parents are both Chinese nationals or one of

abroad, or one of whose parents is a Chinese national and has settled( \/ m+ f$ x$ u9 J
abroad, and who has acquired foreign nationality at birth shall not have

Any person born in China whose parents are stateless or of uncertain
* n) L+ U C! Q6 L' Mnationality and have settled in China shall have Chinese nationality.! K; M! ?; m" f4 g$ Q
Article 7* a: r: u: E7 N2 @4 Y- ^! I0 s
Foreign nationals or stateless persons who are willing to abide by China''s
( `# T. h* [# y# D3 n1 ~Constitution and laws and who meet one of the following conditions may be
: R& C3 D: K4 p2 E" Gnaturalized upon approval of their applications:
/ g; ^- A9 C3 O& L- n9 B(1) they are near relatives of Chinese nationals;% O" Y" X9 T* v$ A+ P2 C4 m
(2) they have settled in China; or

Article 8" y6 Y$ x2 a, `! V5 w& i
Any person who applies for naturalization as a Chinese national shall+ H0 K- j: N" v
acquire Chinese nationality upon approval of his application; a person9 r+ ~$ _& p/ s' e2 `
whose application for naturalization as a Chinese national has been
/ I% _# p2 \/ u3 Z1 O$ ?. f9 Eapproved shall not retain foreign nationality.

9 z- Y; y/ }1 P; o! O tAny Chinese national who has settled abroad and who has been naturalized

will shall automatically lose Chinese nationality.1 M; g1 j( W4 n3 W
Article 10
( x# K9 v5 L' F rChinese nationals who meet one of the following conditions may renounce
h- e( R% ^* n* u9 kChinese nationality upon approval of their applications:

(2) they have settled abroad; or

Any person who applies for renunciation of Chinese nationality shall lose) R: G% y. H& _/ N$ c: E
Chinese nationality upon approval of his application.) e0 L) A. O, r- ], N
Article 12
3 Q# }& q9 Q+ ?4 ?0 |4 C5 ~1 OState functionaries and military personnel on active service shall not
/ J; Q5 O s8 G8 rrenounce Chinese nationality.
! \7 m2 q/ D3 Z! f6 T6 }! i% A* rArticle 13
+ D( H: Z) n" aForeign nationals who once held Chinese nationality may apply for7 ?$ M) |* k w4 ]$ Z# w7 x
restoration of Chinese nationality if they have legitimate reasons; those/ k9 G/ z" A% a3 \! ^! w
whose applications for restoration of Chinese nationality have been
. B1 ^. X) t" _approved shall not retain foreign nationality.- Y5 _* G8 @ \2 G2 p
Article 14$ H, ~' M6 j$ P; x4 p
Persons who wish to acquire, renounce or restore Chinese nationality, with
& s' ^% k5 O' `9 ?9 m+ h0 s Athe exception of the cases provided for in Article 9, shall go through the. R7 J1 ]) T4 u, R9 u
formalities of application. Applications of persons under the age of 186 i7 M5 k8 k3 F, k: z T) H
may be filed on their behalf by their parents or other legal n, ~9 b R5 J% Z _
representatives.
' |9 p9 J; e) ]9 WArticle 15, S4 }8 [& e. z( ~$ }" z/ ]' @
Nationality applications at home shall be handled by the public security- O) g8 `$ D1 ~1 E4 p; _
bureaus of the municipalities or counties where the applicants reside;
: S( n0 i- n3 h3 f; M% a1 Hnationality applications abroad shall be handled by China''s diplomatic- k4 z6 z n6 m
representative agencies and consular offices.' g/ ?9 \; \& f- |# s7 H' Q0 ^
Article 16
: R1 p2 W! g" \ T8 Z6 P5 oApplications for naturalization as Chinese nationals and for renunciation/ i% r7 x: O" `$ S) @/ X
or restoration of Chinese nationality are subject to examination and% {1 Q) y/ v8 v p- ?
approval by the Ministry of Public Security of the People''s Republic of
/ H+ w7 a- H4 VChina. The Ministry of Public Security shall issue a certificate to any
! n& ~* R, ]9 ?" Cperson whose application has been approved.; M# ~: g2 Q, N o" y) f# R6 g$ m
Article 17
& ]( b8 { @4 C- p1 MThe nationality status of persons who have acquired or lost Chinese
, E; i0 S9 G! `8 a5 u& Y4 m0 h, ?nationality before the promulgation of this Law shall remain valid.$ P7 b9 w* K- _+ _* p: x$ t9 U
Article 18
2 j, m' g" ~5 C tThis Law shall come into force on the day of its promulgation. |
