0 Q1 @4 N0 A6 V《中华人民共和国国籍法》 % J; r0 h5 c% V( |3 y
  # x. e5 V" ^/ R7 x
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。) w  W4 l1 I# \9 Y- E( K
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。5 L8 ]% P) j3 @2 R
    第三条    中华人民共和国不承认中国公民具有双重国籍。
$ i& \+ P/ ]+ s# k  j5 q7 X    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。4 N* H& z8 @/ Y5 g8 ~
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
: o5 W0 ]  O7 l7 e    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
' S/ K: H$ H3 K, Y8 \    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
: J/ L  U; ^+ N" S, `, S  l$ y    一、中国人的近亲属;
& C' y9 I1 |4 k4 o$ Q; r* Q    二、定居在中国的;0 m) _2 i) C! x1 J; M. U
    三、有其它正当理由。2 k. ~2 i! x1 O
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。+ y' n! H5 I& N
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。/ H% @' B, q1 w+ m( b
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
/ D- Y$ L) p/ v# Z1 o    一、外国人的近亲属;( W* Y- y$ ^! u8 D% s
    二、定居在外国的;* f$ v# e% [/ S
    三、有其它正当理由。
' b; d+ l6 k6 F- o7 X    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。/ N5 s% S% \: _* I" W. K+ D% G
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
5 f: n9 F& d# H6 a    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
( B5 d# l4 ?( W; _4 F    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
& Q; W$ F  l  [+ q9 r    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。% ^0 h' K/ }" u5 o; s2 `3 o
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。! l! E$ M0 T6 K! W) w
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

This Law is  applicable  to  the  acquisition,  loss  and  restoration  of+ {; Z, i  h8 a3 c
nationality of the People''s Republic of China.
, w& g. V0 n* s, L1 g2 u& L3 N8 mArticle 2
. M5 m4 Y  l% I" b, |$ K* A+ b% jThe People''s Republic of China is a unitary multinational  state;  persons
6 G3 q, B1 @; Bbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese
* i7 `- ]* y" Pnationality.* }9 c) s' s( e" f9 m
Article 3
4 D; }6 }- ]) C- ]. `8 OThe People''s Republic of China does not recognize dual nationality for any* e- I1 f* K6 A) d
Chinese national.
+ a- t, f3 i+ T; \6 t) s4 zArticle 4/ z7 }, C  s, f7 M2 y
Any person born in China whose parents are both Chinese nationals  or  one) q1 D( _; h# v- O
of whose parents is a Chinese national shall have Chinese nationality.2 A) b) N4 s/ ~4 K
Article 5
/ H* A, u$ \7 a7 VAny person born abroad whose parents are both Chinese nationals or one  of
3 E! {) J$ H' S6 Z0 Y: cwhose parents is a Chinese national shall have Chinese nationality. But  a5 ^$ \* }3 w: D- m
person whose parents are both Chinese  nationals  and  have  both  settled
( b, q$ s! z; T0 A' I; iabroad, or one of whose parents is a  Chinese  national  and  has  settled: @% m9 q8 W! m
abroad, and who has acquired foreign nationality at birth shall  not  have
- z& n1 l7 e" Z; L1 @2 kChinese nationality." x) q% u& S* H% G. C
Article 66 S9 k0 W: a) y( |6 C! c0 L
Any person born in China whose  parents  are  stateless  or  of  uncertain$ R( v: [% B0 l( a& S6 K
nationality and have settled in China shall have Chinese nationality.
6 I6 ?% {1 N9 l* O" W+ jArticle 7
5 z" `! V, J1 jForeign nationals or stateless persons who are willing to abide by China''s2 J* d% J, R" ]
Constitution and laws and who meet one of the following conditions may  be. H0 {9 @" M3 y3 m" p0 m
naturalized upon approval of their applications:
. Z0 {: q, _0 y- z4 O( X(1) they are near relatives of Chinese nationals;
, S6 B7 y: M' v' \: Z; M, w(2) they have settled in China; or+ I) P* Q; j- c- {8 w  ?  w
(3) they have other legitimate reasons.) G$ n$ t6 B$ @
Article 8
9 N8 ?. t  @5 Q; l1 R& M) n1 P" pAny person who applies for naturalization  as  a  Chinese  national  shall
5 i3 s) i4 w& ?- Z$ e( \4 Q6 Aacquire Chinese nationality upon approval of  his  application;  a  person' j+ L* d3 u  h) d
whose application for  naturalization  as  a  Chinese  national  has  been! m0 S, m( H! j; J1 p
approved shall not retain foreign nationality.3 e- f0 l; ~: |/ U( G
Article 9
7 F. C' ^+ J1 s9 m2 aAny Chinese national who has settled abroad and who has  been  naturalized% L0 x6 R: ]: I. p' P) j
as a foreign national or has acquired foreign nationality of his own  free
. X6 F/ U: f8 p) Bwill shall automatically lose Chinese nationality.0 F% t. j! Q  q- ?
Article 10
# F/ U8 H6 x" n" \8 J! w9 M6 cChinese nationals who meet one of the following  conditions  may  renounce  S6 B$ X- x( E) S
Chinese nationality upon approval of their applications:
5 l* m8 N! t1 A7 [! i2 ~$ H(1) they are near relatives of foreign nationals;- _; v2 \7 M: P) A0 c
(2) they have settled abroad; or
5 [  r" ?' J! t3 J9 R+ k) I! V(3) they have other legitimate reasons.
# j/ }6 ]3 n2 V7 ZArticle 11
5 o8 G9 d$ a- r$ _) D& J" xAny person who applies for renunciation of Chinese nationality shall  lose
3 C6 ]+ @9 t" {* G0 mChinese nationality upon approval of his application.1 f3 }% H  W0 o# _# d: {
Article 12* s5 @! M+ O$ Y' t0 h& W
State functionaries and military personnel on  active  service  shall  not3 W9 p/ h5 n  `6 ~* @$ i
renounce Chinese nationality.% S1 `8 |! g) V
Article 13
9 ]$ l' k! T. y8 {/ x6 z+ PForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
! `" A4 E* |  U5 P/ n8 @4 Z4 ]restoration of Chinese nationality if they have legitimate reasons;  those8 c2 ~3 |8 T  O6 b( n
whose applications  for  restoration  of  Chinese  nationality  have  been
- ]/ j6 i( G6 N, J& l8 fapproved shall not retain foreign nationality.
2 j& Q! O% A& n6 N: M5 M4 ^Article 14
" ]' Y3 {& I0 o9 C1 J, t, N1 Z$ W: SPersons who wish to acquire, renounce or restore Chinese nationality, with) y& ]/ L0 _* _. o6 K! F
the exception of the cases provided for in Article 9, shall go through the; _& a7 g, J3 B( k# D
formalities of application.  Applications of persons under the age  of  18
( c) V4 V* B+ c% Tmay  be  filed  on  their  behalf  by  their  parents   or   other   legal9 i2 ~. I) _$ I$ T4 B: ~+ Q/ l
representatives.
9 B1 {0 x( H9 f: CArticle 159 k- N7 T% l" Q" P# z$ |1 L- Z, c  \+ J* L
Nationality applications at home shall be handled by the  public  security* t$ a7 h( ?3 C& L; Z" y7 I, p7 _
bureaus of the municipalities or counties where the applicants reside;4 r5 S4 b& c/ i2 N( Z+ u* l% x- t
nationality applications abroad shall be  handled  by  China''s  diplomatic
" v$ ?% z4 a7 w* Wrepresentative agencies and consular offices.* b+ g5 [! a1 T6 o7 ]
Article 16
2 i  N/ F- y9 jApplications for naturalization as Chinese nationals and for  renunciation* X' `/ Z) P, ?, B, e7 O1 B
or restoration of Chinese  nationality  are  subject  to  examination  and
. `7 s( }; B, W  O2 P6 P( lapproval by the Ministry of Public Security of the  People''s  Republic  of
4 D' c$ h: a3 {# b( u+ PChina. The Ministry of Public Security shall issue a  certificate  to  any
8 }1 P7 m: I$ ?person whose application has been approved.
* ?: T8 Z- i/ p' N4 B+ s3 WArticle 17/ B, ?) ?$ w+ T" w" i3 ]
The nationality status of  persons  who  have  acquired  or  lost  Chinese
5 ^/ W2 k+ l  s5 Gnationality before the promulgation of this Law shall remain valid.0 u- j  P2 Z5 A3 |1 A0 [
Article 18  M; _: ]1 i5 B( s0 u, j
This Law shall come into force on the day of its promulgation.
