4 g- n: d2 P1 L* t8 n《中华人民共和国国籍法》 & x# j; [, a' j# w
 
! P$ m1 I1 m4 s7 Z 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。* A8 k  e" x" q' W/ H
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
9 p& S2 L; h0 ~3 K. o& c6 s" ^. s    第三条    中华人民共和国不承认中国公民具有双重国籍。
/ e. G# _0 g6 h    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。( s' Z8 ^0 v! h! R; p
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
- r4 K0 G, i- X6 ^" I$ m    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
' W3 V3 j4 F6 u+ e9 L1 r6 d( n    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:3 ^' G' Q! j7 g/ z9 p8 Y5 M( w# f
    一、中国人的近亲属;
* }9 m: c! \# \    二、定居在中国的;$ r% t+ I" ^" L) W! B* b
    三、有其它正当理由。$ x0 X2 U+ Y! N0 d* P! t" v
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
2 p6 D5 x/ A1 N# |/ p4 k" z    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
  D1 Y5 S: B7 \$ e- U    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
& h0 q- b: {* b    一、外国人的近亲属;8 ]6 S9 ~, ^$ G7 }( f) T! @  _
    二、定居在外国的;! Z& u5 O- e2 y2 Z
    三、有其它正当理由。
, I/ A+ s" n0 `    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
* p% W. {7 |+ P+ i! n- f1 x    第十二条   国家工作人员和现役军人,不得退出中国国籍。: M  K8 p+ q* I5 j) P: j# E' Z
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。: z6 h. F8 @: E. h
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。0 Z. m% ~9 h" ~
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。& k! d, \2 N5 E# [' y; e5 L
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
3 f8 ]$ N; l% t% i& w    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。- T6 _% V/ ~5 `9 l
    第十八条   本法自公布之日起施行。: ^- P) c& L% s1 L' x$ V5 V4 T

NATIONALITY LAW OF THE PEOPLE''S REPUBLIC OF CHINA

Congress, promulgated by Order No. 8  of  the  Chairman  of  the  Standing' u& @7 j+ e* `
Committee of the  National  People''s  Congress  on  and  effective  as  of

) R6 f6 |% X0 V- {; tArticle 1
. F: z- L& F8 rThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of
% a- D: l3 w: H' Ynationality of the People''s Republic of China.
! R2 n! p; k: Q1 @Article 2
# I# j% W4 `" v% iThe People''s Republic of China is a unitary multinational  state;  persons/ u% P' j. I. H) u. S
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese9 v8 U% R  \4 J0 A
nationality.3 o( n$ e( M" F3 Y; K. }
Article 30 [9 x: U+ I$ }4 J* d) ]
The People''s Republic of China does not recognize dual nationality for any6 h5 g. m8 m  N
Chinese national.

& Y+ _! J! h; k7 f* IAny person born in China whose parents are both Chinese nationals  or  one# q& q$ A! z0 }/ }6 K; Z
of whose parents is a Chinese national shall have Chinese nationality.

6 x7 X$ h) E7 @$ \* VAny person born abroad whose parents are both Chinese nationals or one  of
2 F" N+ P9 S0 W- ^8 Xwhose parents is a Chinese national shall have Chinese nationality. But  a6 n3 n: d; l, {- }+ K
person whose parents are both Chinese  nationals  and  have  both  settled' i" R1 N4 v  k- H* K- V4 X
abroad, or one of whose parents is a  Chinese  national  and  has  settled
( A1 n: _1 U4 uabroad, and who has acquired foreign nationality at birth shall  not  have
9 H$ i5 S  y; wChinese nationality.
3 e* [* u. _/ M" @9 h$ |; v2 L1 gArticle 6' d$ I) y6 v; S/ l
Any person born in China whose  parents  are  stateless  or  of  uncertain
( w# _" @7 I% vnationality and have settled in China shall have Chinese nationality.2 e' ]+ B3 d) D. N. Q
Article 7
# J+ F+ S1 c4 w! `/ j2 }: A3 sForeign nationals or stateless persons who are willing to abide by China''s! e; V1 o2 q8 z; B7 Z& Y
Constitution and laws and who meet one of the following conditions may  be7 m. a% a- `8 @, v5 l" |
naturalized upon approval of their applications:
# l7 s1 X6 e0 [7 Q* {, _9 J(1) they are near relatives of Chinese nationals;
- U3 S' i/ ?7 \. `6 i/ T6 r(2) they have settled in China; or8 @$ m7 E, h! |; A  P# k& A
(3) they have other legitimate reasons.& e; y8 d7 v) O4 u& s8 [' o' Z
Article 8
, q! f  k+ H% K- F- l# ZAny person who applies for naturalization  as  a  Chinese  national  shall
3 s) \- D1 R" s% h0 h" wacquire Chinese nationality upon approval of  his  application;  a  person% m% S3 D5 f# _0 i& M1 D
whose application for  naturalization  as  a  Chinese  national  has  been
% ~4 \) H4 R& y8 Tapproved shall not retain foreign nationality.
  Z) A9 C* c7 v2 FArticle 90 W2 U0 p# F; w4 u: U5 F, E
Any Chinese national who has settled abroad and who has  been  naturalized- i2 P1 e" {* E
as a foreign national or has acquired foreign nationality of his own  free
& q4 e1 L& _& T8 {) y$ Ewill shall automatically lose Chinese nationality.6 ~( u* q. Y3 K# ~! V, V
Article 101 k, x7 E% X2 B. H) D
Chinese nationals who meet one of the following  conditions  may  renounce, ~! }7 [1 r9 a- _9 R! C
Chinese nationality upon approval of their applications:
# Q( [) w6 z# W(1) they are near relatives of foreign nationals;
: U& k2 K0 Q: m. _$ t$ N0 L(2) they have settled abroad; or; j: R! t( K& C# f* m9 E
(3) they have other legitimate reasons.
( K( M( m) V/ c, j& S# LArticle 11
4 p% O* M4 f! b) DAny person who applies for renunciation of Chinese nationality shall  lose
& O7 ^2 W8 ?# [2 zChinese nationality upon approval of his application.
1 z0 ]7 h  X1 o) V' cArticle 12
$ H0 W* k& w. HState functionaries and military personnel on  active  service  shall  not, z2 _! O; j  ]0 J/ q$ ~0 {, H
renounce Chinese nationality.8 S9 B  ~2 Z0 L% J8 A  L, |& x
Article 13' _- u. r0 }+ v
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for8 J. _- O6 p& K# H& ^
restoration of Chinese nationality if they have legitimate reasons;  those
* y( ^8 p# V: n. k3 @2 H7 pwhose applications  for  restoration  of  Chinese  nationality  have  been' U: \; N5 G" g' m/ u+ d
approved shall not retain foreign nationality.
/ g6 ^/ j. {# d# ^5 s( l9 D+ B, DArticle 14
4 V  p% f" L2 k* }, aPersons who wish to acquire, renounce or restore Chinese nationality, with) Z; r3 |! M$ t% ^- J9 w
the exception of the cases provided for in Article 9, shall go through the0 {5 j( V. _3 G. x: H
formalities of application.  Applications of persons under the age  of  18
0 n( W' a  o) ^& B$ S- ?may  be  filed  on  their  behalf  by  their  parents   or   other   legal  r+ L( q4 T  N+ E
representatives.
/ K1 m/ T# u* F! u& s% TArticle 15" X, r9 d6 o/ i2 `4 z. W
Nationality applications at home shall be handled by the  public  security3 ]: f% S, t3 F+ F. `' G
bureaus of the municipalities or counties where the applicants reside;  @- j7 t2 P! N3 N, X1 {6 _6 s
nationality applications abroad shall be  handled  by  China''s  diplomatic5 S% `. l, W4 d
representative agencies and consular offices.
6 z4 P+ w9 n. i5 c( c6 OArticle 168 k* P8 H5 H) I- s0 x
Applications for naturalization as Chinese nationals and for  renunciation
' e& k+ B1 w' t9 t7 r; ]) X: M* dor restoration of Chinese  nationality  are  subject  to  examination  and
% h3 {/ J! r2 U9 [$ Q8 S6 bapproval by the Ministry of Public Security of the  People''s  Republic  of
' g9 z, x  |$ v) `China. The Ministry of Public Security shall issue a  certificate  to  any! K! `+ l: @; K$ b4 \
person whose application has been approved.4 E* {+ M- N& n9 C( [
Article 17
0 h$ m# a4 K) l9 KThe nationality status of  persons  who  have  acquired  or  lost  Chinese
$ j9 j: ], U) \nationality before the promulgation of this Law shall remain valid.
3 O! ~* a0 q$ x3 E1 AArticle 186 k9 o; E. o: k" p
This Law shall come into force on the day of its promulgation.
