《中华人民共和国国籍法》

; z4 O! n4 h/ P0 ~ 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。& w" l* X1 G* Y0 i
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。1 W- b. R, O  _4 ?$ s" Z4 q7 A
    第三条    中华人民共和国不承认中国公民具有双重国籍。
- G+ v. [' R! @0 {    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
8 _' m; I" e/ ]7 D2 O  G% l    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。$ k( I: v1 r! q6 \
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
2 l% ]2 @/ Q0 N4 r% A- J: d    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:' E1 `4 C5 i$ u
    一、中国人的近亲属;
; ^; P" _; o# N. u6 t- ]    二、定居在中国的;
- _  }! \5 j2 H, @    三、有其它正当理由。
% Y5 D5 i3 O1 ]    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。/ X/ g- V$ Y$ g9 M
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
# }, b5 t: v* y. P$ l    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:3 f3 v, r* g9 @, ?  w! N
    一、外国人的近亲属;2 T9 I9 H7 {: ~' `; s/ v6 d
    二、定居在外国的;
$ K+ N. y- Z( x/ U+ N+ e/ J    三、有其它正当理由。8 D+ H2 _1 P5 L2 `; I3 n4 O- ?
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
$ b5 ?! V5 R$ e$ s! C5 J    第十二条   国家工作人员和现役军人,不得退出中国国籍。' B- m$ R  S, C& U/ f
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。8 L9 ^' p6 Y& N  P% S
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。# F3 E4 L% d" M
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。2 P- n+ p4 G& |. t! P
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
% j0 I5 I( N, u1 C    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Article 11 X( W9 B% `" }$ W
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of' z2 T7 ?5 |: U" L
nationality of the People''s Republic of China., W- v, h# C/ O
Article 27 m4 J7 ]- @  \6 V: d! F0 R
The People''s Republic of China is a unitary multinational  state;  persons
1 g8 ^/ ^  z6 m! k  ~belonging to  any  of  the  nationalities  in  China  shall  have  Chinese$ u; Z% }1 t' K; s+ E( o
nationality.# E" I2 a* V6 r0 x$ F$ f
Article 3
0 o* l9 \! x- H5 M* \& UThe People''s Republic of China does not recognize dual nationality for any
( p5 g. A1 g$ v, j5 d! oChinese national.# i/ b1 c! e& ]6 p/ {1 r. l& i
Article 4' j. Z" {6 \9 u8 m% ^7 m
Any person born in China whose parents are both Chinese nationals  or  one" q5 ~$ [' x6 I) }% j; F5 |
of whose parents is a Chinese national shall have Chinese nationality.# R" ~/ |7 ?' }0 M3 m5 U
Article 5
- ^+ F. `* m- H8 p6 T/ ~/ `$ jAny person born abroad whose parents are both Chinese nationals or one  of3 F6 \, z' G+ J4 W* _
whose parents is a Chinese national shall have Chinese nationality. But  a6 v$ x( }8 J# Q
person whose parents are both Chinese  nationals  and  have  both  settled- q7 T$ e8 z, C/ M5 n4 b3 F
abroad, or one of whose parents is a  Chinese  national  and  has  settled
3 z, Q0 K4 U0 Oabroad, and who has acquired foreign nationality at birth shall  not  have
/ ]. o' e& |9 w) b) G  I3 ~; OChinese nationality.
; T' P' ]$ }# m, ^Article 6/ g3 ^: P% H& h2 F
Any person born in China whose  parents  are  stateless  or  of  uncertain% X0 ^+ o$ J* u+ e. V$ C, S6 N
nationality and have settled in China shall have Chinese nationality.
" G/ h0 W1 N6 l- m* ~Article 7
* ]( l8 n2 f5 H# c) ?% @# e8 n* GForeign nationals or stateless persons who are willing to abide by China''s
, z' S: b- c) v% H/ u; \Constitution and laws and who meet one of the following conditions may  be2 p' S3 E" ?3 x4 c
naturalized upon approval of their applications:
) I7 G2 T+ ]9 Q# r/ W$ Q(1) they are near relatives of Chinese nationals;
# R' |7 ]( @5 \! [. r! r(2) they have settled in China; or! Z" B5 L+ q* j4 m. d
(3) they have other legitimate reasons.
, b  U9 y: s- [  d5 q; u! aArticle 8" ^  x/ D0 l! [
Any person who applies for naturalization  as  a  Chinese  national  shall
0 n. `* q" z, Pacquire Chinese nationality upon approval of  his  application;  a  person
: w2 {. l3 {( A$ v/ wwhose application for  naturalization  as  a  Chinese  national  has  been  ~% Q8 R( e  c$ p
approved shall not retain foreign nationality.0 T7 R: N( }( M% V4 I
Article 9! G# P+ q0 Y  o2 s( |( G. m6 X
Any Chinese national who has settled abroad and who has  been  naturalized
0 n$ F( q8 v0 i( Fas a foreign national or has acquired foreign nationality of his own  free% q- q( G+ j: _! [( r7 n
will shall automatically lose Chinese nationality.
9 [8 l9 z) h7 n! B6 r# BArticle 10
: |  Y4 ~( J! gChinese nationals who meet one of the following  conditions  may  renounce
. }: _6 \+ d! g) xChinese nationality upon approval of their applications:# w# i% l9 w$ K6 {
(1) they are near relatives of foreign nationals;
0 s9 i3 j0 F4 r5 v+ \7 n(2) they have settled abroad; or
( z' u0 U4 v. Q  ~(3) they have other legitimate reasons.
8 q) [  j; h' H" M# T2 L' CArticle 11
  h, |  b' O- M. h% JAny person who applies for renunciation of Chinese nationality shall  lose
% Y4 U1 t8 z3 c  ]6 V$ v6 fChinese nationality upon approval of his application.
, p+ E0 ^5 k1 V# C) @: eArticle 128 S6 a9 v0 W+ H! L; I4 E
State functionaries and military personnel on  active  service  shall  not
& v* Y; j, C% Xrenounce Chinese nationality.
4 O  Z# V6 P" j+ b  y" |6 ]Article 13
. x' \& R/ X' P4 m* g3 V8 nForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
* f) |. i0 q+ }restoration of Chinese nationality if they have legitimate reasons;  those
& Z, U8 v7 B" Q# q: g! m$ dwhose applications  for  restoration  of  Chinese  nationality  have  been
- q. p& ?9 U7 E: J* Tapproved shall not retain foreign nationality.
- p* y7 q) H- T6 V$ E. _Article 14
3 p7 j/ e) o5 \% v& x' rPersons who wish to acquire, renounce or restore Chinese nationality, with1 V$ _# v# I, ]4 j7 A! V/ i
the exception of the cases provided for in Article 9, shall go through the7 m0 f+ Z' l+ H3 I/ t9 f( l
formalities of application.  Applications of persons under the age  of  18
; }) ?9 f4 [/ d8 R& T. S, [may  be  filed  on  their  behalf  by  their  parents   or   other   legal
9 d, r, s6 ?; T9 J" Hrepresentatives.! F: x. Y, m4 a/ ~; _/ l
Article 158 W2 Z6 g- ]& n% [
Nationality applications at home shall be handled by the  public  security/ h, G1 M" H/ r
bureaus of the municipalities or counties where the applicants reside;( z& p0 J, d3 g5 g4 v: u
nationality applications abroad shall be  handled  by  China''s  diplomatic
, G. @3 J" n/ Zrepresentative agencies and consular offices.
2 K8 c" J% V9 m: ]Article 16
7 ]% S, t9 B2 ?: @Applications for naturalization as Chinese nationals and for  renunciation
9 @: O3 O( ]# M6 m) por restoration of Chinese  nationality  are  subject  to  examination  and2 u' y) j- o" h8 d
approval by the Ministry of Public Security of the  People''s  Republic  of& I1 r" |' Y# _6 Q+ `/ y" I7 n
China. The Ministry of Public Security shall issue a  certificate  to  any+ [& Q0 k' R+ x- Q
person whose application has been approved.$ s' L8 ^1 Z* P; c. g
Article 17
8 |3 ]( {0 Q3 e4 y  qThe nationality status of  persons  who  have  acquired  or  lost  Chinese" q; G3 D3 Z0 {0 R$ Z% ]
nationality before the promulgation of this Law shall remain valid.! X% B9 {7 o5 Z0 r/ I# H" E
Article 18( \, Q5 `$ O% b& ^/ _% O( e5 G( r5 |
This Law shall come into force on the day of its promulgation.
