2 c8 k6 u5 O! ^/ ?2 h 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。# y9 t# H* C( x
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。# i( _* ^0 y2 A3 \
    第三条    中华人民共和国不承认中国公民具有双重国籍。8 ]" S6 `) q; \5 _# J5 K
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。- d/ K2 H% F8 A
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
. H/ Q6 Z# O" M& T& z, J# K    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
9 X+ ?0 k# v: T' }/ ?3 l    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:: V- l. t$ M% [/ L- x. {
    一、中国人的近亲属;8 k. L9 u7 r! A' a: ]7 f8 r2 a
    二、定居在中国的;% S% z9 {. K0 s# E9 E
    三、有其它正当理由。8 J6 [, w/ @  }
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。7 _* `* w% e/ f, Z; u. V0 l0 S- {$ X
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
6 Y$ p( Y5 d$ Q" L+ z5 H    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
' d3 o) D% n! |/ o    一、外国人的近亲属;
4 k! t. G: [1 v    二、定居在外国的;3 N  {& m# d2 q; e9 Q5 l
    三、有其它正当理由。1 r4 g5 k! ^; Y, H
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。5 s7 T  {7 |4 d
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
- G8 o+ s7 Q) B  F! ?+ T7 N4 p    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。8 s0 w- ?: o& P+ ?. _
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
- P. s7 X$ h$ H; \    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。& [8 c6 I- R; \8 {* E
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。: C. L: d: @+ Q* Q4 v1 s
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。5 y$ W2 P/ x# `' q& A5 O- ?
    第十八条   本法自公布之日起施行。

Congress, promulgated by Order No. 8  of  the  Chairman  of  the  Standing: ~4 S# x! [0 [1 X

This Law is  applicable  to  the  acquisition,  loss  and  restoration  of, u1 T, r& P: ~5 s% o, {
nationality of the People''s Republic of China.: i* v$ E. ?5 F; V# t, ]
Article 2
3 Q& i1 o4 ]& u. IThe People''s Republic of China is a unitary multinational  state;  persons
( g, g% R$ J! [8 v  Kbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese# W3 s6 I  \, L1 K
nationality.! _5 z' V1 g% r+ q9 M5 l% U5 @% l
Article 3
. {. L, {2 h- p) T2 [The People''s Republic of China does not recognize dual nationality for any2 t; m" B# U' Y4 h# b
Chinese national.4 b- n1 L- L* ], A4 O' l. X' S/ I
Article 4
6 i( H- A2 k6 r" D7 nAny person born in China whose parents are both Chinese nationals  or  one
# d# D5 |5 {+ \& xof whose parents is a Chinese national shall have Chinese nationality.! z2 @6 Z9 a2 R% x% T2 S
Article 5" [; T$ p$ }( E, A
Any person born abroad whose parents are both Chinese nationals or one  of
! R1 i7 v! d' C' Bwhose parents is a Chinese national shall have Chinese nationality. But  a! d) a9 p  G: ]( t( ~
person whose parents are both Chinese  nationals  and  have  both  settled
7 i) b5 \3 r" q# gabroad, or one of whose parents is a  Chinese  national  and  has  settled
' a6 `6 [6 o  ^0 G" nabroad, and who has acquired foreign nationality at birth shall  not  have
1 Z/ t- s/ w0 I  N  m% M$ f3 V$ x* eChinese nationality.' H5 i0 H& H/ a1 h3 l7 m5 V& T
Article 6
# z0 A4 Y$ w3 x7 F3 C0 p2 Y0 S5 WAny person born in China whose  parents  are  stateless  or  of  uncertain! R  P; n; U- N: _& g3 X( h
nationality and have settled in China shall have Chinese nationality.
/ [: t% c  M  _. O0 n5 n7 EArticle 7) N6 ?; t$ D8 O; Z8 s. C
Foreign nationals or stateless persons who are willing to abide by China''s- ]) W' r! X2 X% J1 Z) V
Constitution and laws and who meet one of the following conditions may  be7 W2 o6 n) T7 m. }  p3 W+ X
naturalized upon approval of their applications:
2 t0 h6 z* ]+ E5 Y# x' N+ V% Q(1) they are near relatives of Chinese nationals;
/ ~- Z+ J# [, y' l! W/ O6 `(2) they have settled in China; or3 z+ q' ~5 Z$ F: T$ ?
(3) they have other legitimate reasons.. I. e1 F4 G0 z( e
Article 8
. a& ?* Q+ l7 m* X5 @7 u# KAny person who applies for naturalization  as  a  Chinese  national  shall8 Y1 }; F% ]) s+ ~0 b, y4 h
acquire Chinese nationality upon approval of  his  application;  a  person4 e9 g- @2 }2 s9 {4 Y' q; M/ F
whose application for  naturalization  as  a  Chinese  national  has  been. }; ^  u+ H  z, C8 P+ t; ]
approved shall not retain foreign nationality.
) x3 ]2 f) t+ {; Q- y+ F' ]- S  pArticle 9
. w$ v6 t: z6 M) `  fAny Chinese national who has settled abroad and who has  been  naturalized# m5 v* j5 S! Q' L8 P
as a foreign national or has acquired foreign nationality of his own  free# a) R0 F7 C; _7 C
will shall automatically lose Chinese nationality., t. f4 P. A# f6 b: c9 J
Article 10
+ |2 ~7 \0 {9 t& l' uChinese nationals who meet one of the following  conditions  may  renounce5 e# |* F" o% |
Chinese nationality upon approval of their applications:+ @* Q. X1 l! T" s. Q7 I
(1) they are near relatives of foreign nationals;
9 g+ v9 ]5 C! ]( T& U- o, p) L4 o(2) they have settled abroad; or
* S( d! ~+ J' q1 Z1 U(3) they have other legitimate reasons.: `' {: T0 C" ^; z; f2 j& t: V
Article 11
" h+ Q' ]7 `/ a4 WAny person who applies for renunciation of Chinese nationality shall  lose
/ R8 }. p) x: s6 p6 }% [" UChinese nationality upon approval of his application.2 `8 L) @3 a( i9 B- n
Article 12( Y% [- |% e7 G! f4 P( ]( h
State functionaries and military personnel on  active  service  shall  not! D' N! K' q& u: j. F% |" p
renounce Chinese nationality.! @; d) t! Q9 f( r5 ]7 z) ?
Article 13- g$ I. z2 S  M4 p2 m
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for* m& j' }3 {& q" }. T
restoration of Chinese nationality if they have legitimate reasons;  those
" g) n9 E6 w' Y: o/ o; dwhose applications  for  restoration  of  Chinese  nationality  have  been) Z# v7 _: I$ D5 P$ G3 D0 ~2 c
approved shall not retain foreign nationality.' ~/ J7 K7 ?, Y7 ~/ F* U
Article 14
2 t, [4 P8 e& n$ d) WPersons who wish to acquire, renounce or restore Chinese nationality, with
5 [( N* j' Y4 q  I) Wthe exception of the cases provided for in Article 9, shall go through the+ A# F' j) ~' D  L( u" i
formalities of application.  Applications of persons under the age  of  18
4 @3 W  w# t) I$ A: `$ lmay  be  filed  on  their  behalf  by  their  parents   or   other   legal; X7 T! e7 A& i
representatives.0 ]+ ]! P' v4 Y+ H$ K3 P/ g
Article 15
6 q: }7 H1 c+ D  k: I4 DNationality applications at home shall be handled by the  public  security3 @/ N' U" ?" j; f4 F
bureaus of the municipalities or counties where the applicants reside;
$ t- x* e  t0 v$ Inationality applications abroad shall be  handled  by  China''s  diplomatic
5 D% V1 J, ?' i# n5 m9 z1 Zrepresentative agencies and consular offices.# B# ]3 Q3 h* B5 t  L' B7 ?
Article 16
* Z) ~0 H& Y. J1 t7 fApplications for naturalization as Chinese nationals and for  renunciation6 X% J& v. ^  B* F% c% g6 V
or restoration of Chinese  nationality  are  subject  to  examination  and
1 z% x: |* v* m6 H. k! v: japproval by the Ministry of Public Security of the  People''s  Republic  of
% \- S6 v' ?" IChina. The Ministry of Public Security shall issue a  certificate  to  any' ]" H9 P0 [3 J6 P
person whose application has been approved.* ~# z; L* H* x" j$ j& r% W
Article 173 S* g& ^2 I+ d  m, b
The nationality status of  persons  who  have  acquired  or  lost  Chinese
0 c9 n3 Z  O( \$ f- ?9 Bnationality before the promulgation of this Law shall remain valid.
; P/ i# i8 h) g' p$ Z9 _Article 18# Y( A* v; J9 P2 ^8 L
This Law shall come into force on the day of its promulgation.
