0 N" w$ ]) @; {  v. `& \ 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。! s1 X8 K. t. R; r
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
; G$ S5 F, X+ B& I9 ^    第三条    中华人民共和国不承认中国公民具有双重国籍。. ?& l' k" h4 e8 R
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
$ F' T$ [. c# M3 B    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。2 C/ P. m: i& e  z; m  b
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。0 C6 Q9 _5 c8 G& k
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
2 s+ X- b! q& Z" X    一、中国人的近亲属;
/ x: |5 p' C3 O    二、定居在中国的;
9 H9 x5 H7 q' K' \; {    三、有其它正当理由。& B  P- E! h  G" I0 O8 E% j
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
9 ?$ ?3 y8 ]2 E5 \8 ~7 l* i    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。0 o8 _2 r( A% n3 P% }2 D
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
0 m* y2 u4 c  c5 S) X/ O2 L    一、外国人的近亲属;
9 v/ y. }7 c4 G/ V0 x    二、定居在外国的;
! L9 c' Z+ b7 U8 m    三、有其它正当理由。
0 l0 J- F+ L" O" F  R) n7 w    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
! x* l! \$ k( z. Z: [) c9 {4 F    第十二条   国家工作人员和现役军人,不得退出中国国籍。9 e! S. v+ P5 s9 f! F% A( T
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
8 |. X8 p7 Z5 O) P  R    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。! V! c7 @% S5 P6 z
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
3 `' b4 p" a4 R* j6 y- a+ q    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
1 t  u- S* J; ~    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。! R( F: R8 Y6 p8 ~! o
    第十八条   本法自公布之日起施行。

Article 1. E$ i3 m0 [: \! \
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of! j! `* n/ D% r0 S* ]
nationality of the People''s Republic of China." E) m7 q: `' H2 t/ |. H8 a
Article 2. G1 k  J- G+ N4 q3 T, P
The People''s Republic of China is a unitary multinational  state;  persons
# S: C5 `! b5 r" T5 [0 |/ cbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese
+ V/ }) }6 U, E8 a) jnationality.

The People''s Republic of China does not recognize dual nationality for any
. Q2 l# t5 V- N9 [1 s: aChinese national.4 {2 K3 c* o/ {. f" b) ^
Article 4
( E% y, C! {4 o5 wAny person born in China whose parents are both Chinese nationals  or  one5 F/ o3 i  g& M* {" f2 J
of whose parents is a Chinese national shall have Chinese nationality., Z6 U1 v' `& M: v
Article 5
; @0 K. B3 ^/ H+ w. z3 [Any person born abroad whose parents are both Chinese nationals or one  of4 w& W/ D2 w! ?- h# {
whose parents is a Chinese national shall have Chinese nationality. But  a
$ B$ u* q: _/ h# D7 @person whose parents are both Chinese  nationals  and  have  both  settled
" ^& [3 {1 R! i, b3 z; W. cabroad, or one of whose parents is a  Chinese  national  and  has  settled
! {: \( T4 c& \$ C/ X* kabroad, and who has acquired foreign nationality at birth shall  not  have6 z" f- _; E9 n5 r
Chinese nationality.

, W' E' ?- L2 X  UAny person born in China whose  parents  are  stateless  or  of  uncertain1 K3 y- V  W( B' w3 u' L1 g
nationality and have settled in China shall have Chinese nationality.  v( @8 ]1 w+ K/ ?
Article 70 B+ N; m6 }/ z# m
Foreign nationals or stateless persons who are willing to abide by China''s
4 d2 z3 l1 f2 mConstitution and laws and who meet one of the following conditions may  be! \6 N' Q& `) H+ x9 A
naturalized upon approval of their applications:# |1 o' W" P+ ~. ~+ z$ y. ^' w
(1) they are near relatives of Chinese nationals;
) C/ t! j2 \! T, X1 D0 E(2) they have settled in China; or
) h8 A( v, g7 G- y7 L7 }( z; q(3) they have other legitimate reasons.

+ x+ A5 _  T9 s& D+ dAny person who applies for naturalization  as  a  Chinese  national  shall
2 {* L9 R1 s9 pacquire Chinese nationality upon approval of  his  application;  a  person
' y3 H& ?1 F4 l3 R5 X2 @0 a: [' i7 nwhose application for  naturalization  as  a  Chinese  national  has  been& F9 t% i% s0 ]4 M
approved shall not retain foreign nationality.& X5 `3 f' \$ b1 W
Article 9
/ b! o, ]9 q$ Y/ i$ H, f1 D5 lAny Chinese national who has settled abroad and who has  been  naturalized6 c& o1 s4 p' ~) L
as a foreign national or has acquired foreign nationality of his own  free( g) Q: e! ]) N" k
will shall automatically lose Chinese nationality.
& [. l) N$ M- ?0 j  NArticle 100 `- Q/ [& |+ K  {4 m
Chinese nationals who meet one of the following  conditions  may  renounce
$ Y: o/ p6 s9 D" \Chinese nationality upon approval of their applications:9 y0 c$ C- J$ u: S! T% q
(1) they are near relatives of foreign nationals;8 `- Y; o, g: ~  `8 K
(2) they have settled abroad; or
2 f) ?- [/ P: X$ |$ G1 e6 F(3) they have other legitimate reasons.
8 a$ |* x1 f) P6 r* Q2 v* KArticle 11" ?+ f6 e  H/ g) V4 d8 z& o( R
Any person who applies for renunciation of Chinese nationality shall  lose5 S- T  `0 R7 x9 _) R
Chinese nationality upon approval of his application.
6 z3 ~; w! G" W1 o6 x* E& xArticle 12  F* D9 r5 g3 B* T: S
State functionaries and military personnel on  active  service  shall  not8 u# ~7 E) ?; [5 T$ y- s
renounce Chinese nationality.; U0 T) p# Z! y2 h+ ^0 s
Article 13
1 _6 h# q, `/ Z5 D7 p1 i' GForeign  nationals  who  once  held  Chinese  nationality  may  apply  for3 `( L2 M# e" g) r6 O' J2 U
restoration of Chinese nationality if they have legitimate reasons;  those
* r$ z1 K) @  ^( I6 S5 v' Hwhose applications  for  restoration  of  Chinese  nationality  have  been9 S. u5 ^4 A" o7 m$ ^" b5 b5 d
approved shall not retain foreign nationality.& C# }# @. W6 a& |! w) w# W
Article 144 \& ~3 `: d! Q9 \& x1 n
Persons who wish to acquire, renounce or restore Chinese nationality, with' o0 b$ V) a! e
the exception of the cases provided for in Article 9, shall go through the0 s( B; Q* e7 p
formalities of application.  Applications of persons under the age  of  18
0 M! o: B5 `: }# b; @9 kmay  be  filed  on  their  behalf  by  their  parents   or   other   legal( k6 I# G, P' O/ \# B; K
representatives.& t% M/ J4 t- |0 e: ~
Article 15
/ G9 v. X$ G& U2 D, M: Q  INationality applications at home shall be handled by the  public  security
. Y$ T+ E; B$ \) c& j/ t8 z/ \bureaus of the municipalities or counties where the applicants reside;" ]6 n1 X. H; f5 b
nationality applications abroad shall be  handled  by  China''s  diplomatic1 a8 P5 C0 L+ Z* O
representative agencies and consular offices.
+ L0 a4 d' U9 I3 X$ n; [; N& VArticle 163 T2 I  I2 O2 e( R
Applications for naturalization as Chinese nationals and for  renunciation
6 s* q8 ~! V+ y3 G! Dor restoration of Chinese  nationality  are  subject  to  examination  and
! Q. v# B, x/ Zapproval by the Ministry of Public Security of the  People''s  Republic  of/ E6 i& P; M  J/ K8 ?7 n+ P
China. The Ministry of Public Security shall issue a  certificate  to  any
+ `2 d# T' G2 @) [; D" k+ ~person whose application has been approved.
% C; F4 w5 P( @: Z* t) @# d- ?Article 17
* M$ m* H# C5 H% H# y$ i3 RThe nationality status of  persons  who  have  acquired  or  lost  Chinese
7 f& y1 i( X# f! h3 H% O5 Snationality before the promulgation of this Law shall remain valid./ |/ H, Q( }) C3 i" O3 b) n3 P
Article 18" o* e, Q/ a" q. B1 g8 t
This Law shall come into force on the day of its promulgation.
