第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
  }3 J: T/ C* z9 X: p8 X7 y6 l    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。, t* e7 H4 o+ n7 U: s+ ?
    第三条    中华人民共和国不承认中国公民具有双重国籍。" Y6 F" H3 o: H4 A
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。9 G# O/ P  b, s3 p" |
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。+ M0 c3 e/ s9 t
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。' V8 Q" r* Y. l8 i) T
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
7 s3 D4 @/ B! t- C: j: q    一、中国人的近亲属;
. X' o7 R& G/ R7 Y* H; w    二、定居在中国的;
6 O% ]8 B/ [" v    三、有其它正当理由。. Y, ~3 `8 o6 k- N% b
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。( q% o, F  h, n0 v+ i) U
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。$ o$ p7 @  s* \6 r
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:6 v; R: }8 y; `5 l: L
    一、外国人的近亲属;( G  u% l7 m  `9 E) Y1 d9 m. r
    二、定居在外国的;
: R6 V7 O2 @/ [; W; e; m    三、有其它正当理由。- E7 j5 X: L: R
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。! j% f9 M  X8 Y
    第十二条   国家工作人员和现役军人,不得退出中国国籍。/ d1 W; {3 s  |1 A
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。6 F: _) z  J3 U4 H- z( i
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。6 V! [! c2 w- b
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。# ^' c6 x7 Q* E0 n! f
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
% B: b  H6 {( B$ e9 C9 }& |    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

, r# {: u, z& Q, r6 ^This Law is  applicable  to  the  acquisition,  loss  and  restoration  of' n6 k# ~- F; Q/ j! c: k
nationality of the People''s Republic of China.1 D! U* s( `. t
Article 2
. y4 m, v& X+ z5 xThe People''s Republic of China is a unitary multinational  state;  persons" J1 a) C) U" f3 s' ~" \
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese& x! z8 Z; v7 M9 L9 U( R
nationality.

1 y+ Q! c, R$ v5 X' J+ kThe People''s Republic of China does not recognize dual nationality for any
( Y2 C# y  T! b+ M2 B3 H+ cChinese national.2 g. B' y- j- Q% i1 p% |
Article 4
  C( e/ D" v$ V) c) j& c6 SAny person born in China whose parents are both Chinese nationals  or  one) r% _; c6 j, i# R: k# {
of whose parents is a Chinese national shall have Chinese nationality.) V* P; F5 C% S) ^/ P, o
Article 56 J+ E% N( c9 e$ N8 i6 y6 ]* M
Any person born abroad whose parents are both Chinese nationals or one  of
/ o* P  Y6 b9 U5 f% |8 w. ?# M7 Kwhose parents is a Chinese national shall have Chinese nationality. But  a/ c5 I* B1 G( Q0 X% k
person whose parents are both Chinese  nationals  and  have  both  settled
( e! n. a# l4 Z7 J/ Y. tabroad, or one of whose parents is a  Chinese  national  and  has  settled, J# ^$ K+ o$ ]# W* o5 g( n3 z5 a
abroad, and who has acquired foreign nationality at birth shall  not  have
% R- G% O0 D: Q; I, y  f; QChinese nationality.
$ E8 l8 |2 Z! {/ XArticle 6" U5 a- ~/ b% X/ U
Any person born in China whose  parents  are  stateless  or  of  uncertain
7 k% V$ o! T4 g+ J* w3 F0 gnationality and have settled in China shall have Chinese nationality.. b; `, j- |' _+ m% [" d/ d
Article 76 W1 I+ r  Q' z. n( ~! B- c' O; S
Foreign nationals or stateless persons who are willing to abide by China''s( x- J3 i* Z. a; B
Constitution and laws and who meet one of the following conditions may  be
; x  J1 F- C* Q0 t1 G2 u; s. fnaturalized upon approval of their applications:
$ i1 J! C8 M& {* g% C(1) they are near relatives of Chinese nationals;; U3 p: g& h1 [8 C6 Z& J
(2) they have settled in China; or
+ y& l" c" X% q8 ^* p2 V(3) they have other legitimate reasons.1 F* o% N& z- w0 Q! z3 N' @5 g
Article 8
7 H; D0 H+ |- ?7 h! I7 ?6 ?% GAny person who applies for naturalization  as  a  Chinese  national  shall9 H$ b3 I* A, J. R9 b
acquire Chinese nationality upon approval of  his  application;  a  person' i% v& g7 p; _
whose application for  naturalization  as  a  Chinese  national  has  been: u- r5 r2 e% S' C* g  R6 ~8 m
approved shall not retain foreign nationality.0 T$ ?! Z' N. p! e+ ?# j9 L
Article 9
6 h2 Y# I5 S% D* tAny Chinese national who has settled abroad and who has  been  naturalized: z* R  d8 i+ e/ ?4 @* ^9 G
as a foreign national or has acquired foreign nationality of his own  free- w% {& p/ n$ u# H
will shall automatically lose Chinese nationality.
+ Z) @: p0 d) N, K4 y4 T2 a% mArticle 100 _; c& B; {, V5 O* t) Q1 @6 z$ u
Chinese nationals who meet one of the following  conditions  may  renounce+ c' A# A& \: t  m2 @
Chinese nationality upon approval of their applications:
! `3 _3 e2 T% u3 C(1) they are near relatives of foreign nationals;4 \% n+ S: v$ D, n: D% [
(2) they have settled abroad; or8 [/ U8 \; s( \
(3) they have other legitimate reasons.
6 k/ s) }. N& V5 [) wArticle 11
- P* g! ]3 Z  M; `Any person who applies for renunciation of Chinese nationality shall  lose
4 A: G/ w: O  m% ]7 n# ]1 aChinese nationality upon approval of his application.
" P9 ^0 m1 J5 L( D! UArticle 12
+ ^) _$ l' m8 VState functionaries and military personnel on  active  service  shall  not- ?2 ^! n& B6 P5 n' p4 n- N
renounce Chinese nationality.
0 }) Z4 R0 k" x' O  E8 XArticle 13
8 e! i8 p9 @$ s4 p$ Z7 {5 a' wForeign  nationals  who  once  held  Chinese  nationality  may  apply  for8 C( C/ p* P" n! D5 [
restoration of Chinese nationality if they have legitimate reasons;  those- F( ~8 C/ ]6 r+ P; X2 L, @5 Q3 d
whose applications  for  restoration  of  Chinese  nationality  have  been/ q& e6 z0 l* U* W( I" p8 d7 R9 d
approved shall not retain foreign nationality.
9 X4 M3 `* K0 z4 W- M# u' L: cArticle 14
6 i# b0 d3 K# v0 O8 G. |Persons who wish to acquire, renounce or restore Chinese nationality, with
! w. W! z' E  h2 l- W: Nthe exception of the cases provided for in Article 9, shall go through the
+ X+ K0 a! a2 T" C1 g( zformalities of application.  Applications of persons under the age  of  182 ^! }! R. w" I. b5 ~7 m
may  be  filed  on  their  behalf  by  their  parents   or   other   legal. [7 f1 q/ {7 k# l' o/ [
representatives./ Y6 Y- l0 v8 x: {
Article 15
+ }- C4 N0 K# N3 P4 K7 v  u4 ENationality applications at home shall be handled by the  public  security1 H  H% }" t) K6 |
bureaus of the municipalities or counties where the applicants reside;
/ w  w. Y+ d% Snationality applications abroad shall be  handled  by  China''s  diplomatic- d; ?& I( e) v2 E- @' o% s
representative agencies and consular offices.% _, b+ G* `6 m+ N( u
Article 16
* E3 C) P: N$ hApplications for naturalization as Chinese nationals and for  renunciation
7 |. W: Z- T) ^' m' ~( O) w& Wor restoration of Chinese  nationality  are  subject  to  examination  and7 Z5 a6 s' M& h! e
approval by the Ministry of Public Security of the  People''s  Republic  of
, i" p' M0 L! \! WChina. The Ministry of Public Security shall issue a  certificate  to  any
4 I4 l, ~: M9 y1 s: W, A/ q3 uperson whose application has been approved.
6 f  b/ L1 }; i. {+ M/ O6 QArticle 174 F: D$ Z- j, l7 }  _% P5 W
The nationality status of  persons  who  have  acquired  or  lost  Chinese2 T  F7 C4 j" A2 G
nationality before the promulgation of this Law shall remain valid.
# h4 O3 F* U  M/ e2 }Article 18
8 v! I! G4 p+ q! p/ d, YThis Law shall come into force on the day of its promulgation.
