《中华人民共和国国籍法》 " L3 Q# _+ P' N& M3 H% W
U$ P o/ n( p) m9 E 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。9 u- [) {8 M6 {% D% D
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。4 U$ O8 C- _7 G
第三条 中华人民共和国不承认中国公民具有双重国籍。5 Q5 X* T; s' X. d; j5 ~
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
6 M% K. K$ U' f, b9 q, _+ | 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。

{. l7 t* A& N+ G4 ~) ~1 } 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
- `8 ^6 }! J7 [# V0 h 一、中国人的近亲属;% q; W' E8 d( E& w% n
二、定居在中国的;
3 J1 i$ }; m' J: `& [ 三、有其它正当理由。
% n& H h# T K+ s; [& i 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
! |2 \- ]5 j: S1 [- H' V 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。% k, a- p) E* ]
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
. y, s5 I- s4 @+ N 一、外国人的近亲属;; e6 Y3 a9 u4 x% v4 `
二、定居在外国的;
# }) m8 }' [3 M; \ 三、有其它正当理由。

第十二条 国家工作人员和现役军人,不得退出中国国籍。, [0 r( v, ^+ `* }3 b
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。! r) m7 M4 u1 a* I: E8 k
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。- E- |% {* u t0 v3 l A9 @8 _
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。% y4 c n* X+ ?7 r8 U$ M
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。: T3 a+ B9 m8 p: u1 s* C
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。1 c$ ~6 T. V2 a3 e
第十八条 本法自公布之日起施行。

This Law is applicable to the acquisition, loss and restoration of; m! g- s6 ], O

Article 2
; o, S3 Y' E6 r& IThe People''s Republic of China is a unitary multinational state; persons
, T l) b3 y4 H# Mbelonging to any of the nationalities in China shall have Chinese

whose parents is a Chinese national shall have Chinese nationality. But a
+ o) r. L* o( Z$ ^person whose parents are both Chinese nationals and have both settled7 Z7 d: B" I5 @
abroad, or one of whose parents is a Chinese national and has settled
$ | S7 J+ ^, O5 N3 `$ Fabroad, and who has acquired foreign nationality at birth shall not have
- g0 w3 L K( k3 u- E- J$ dChinese nationality.

) I( p! u7 ]9 |' f- zAny person born in China whose parents are stateless or of uncertain- S9 U9 G) J) v6 j
nationality and have settled in China shall have Chinese nationality.

/ Z1 \+ y1 c( x; dForeign nationals or stateless persons who are willing to abide by China''s9 e2 j/ ^$ y8 l
Constitution and laws and who meet one of the following conditions may be
8 a# w4 Q n/ X/ p! T" K0 ]6 n. qnaturalized upon approval of their applications:
! s1 T- l/ i( f7 Q4 ^(1) they are near relatives of Chinese nationals;
& O" `* ]6 I' v/ e4 d: Q& ~/ l; a1 e(2) they have settled in China; or
4 B! Q8 ]- `/ v+ ^3 h(3) they have other legitimate reasons.% M. @. M r* u9 q2 {
Article 8
6 D+ \- D9 I- [* Z# ?Any person who applies for naturalization as a Chinese national shall
2 G1 \5 E/ M9 f' z& tacquire Chinese nationality upon approval of his application; a person/ Z+ u5 y3 d3 d- p/ K: J' w
whose application for naturalization as a Chinese national has been
4 n2 e+ D8 I6 capproved shall not retain foreign nationality.! I. g3 ? n, H
Article 9) x+ J3 Q# ]& d$ ]' P
Any Chinese national who has settled abroad and who has been naturalized
* k; K+ X% e/ j4 f+ u9 ^& t+ h& Das a foreign national or has acquired foreign nationality of his own free
" x# K0 x8 R% K1 |' e' Vwill shall automatically lose Chinese nationality.- O' C. T q, m7 J5 u0 G# w0 { h
Article 109 o5 G9 p6 x- e. N
Chinese nationals who meet one of the following conditions may renounce
7 e( T* p5 k J$ ]Chinese nationality upon approval of their applications:
" O- r7 j% y% x: w, D) K) X% w(1) they are near relatives of foreign nationals;, A# \2 O% c0 Y8 [( D t3 ~; x
(2) they have settled abroad; or

Article 11
0 j7 v8 o3 e9 o! GAny person who applies for renunciation of Chinese nationality shall lose
* P3 M$ O& z% C) @* eChinese nationality upon approval of his application.; f& b. t+ @6 V+ a0 t @! ^( |
Article 125 h& \* [! C# G# Z" B. ?! X
State functionaries and military personnel on active service shall not! ~/ @' n& z" ?
renounce Chinese nationality.* |" `$ I/ M, f' A
Article 13
5 s3 M6 Q; ` ?. N2 ~! C, t2 F6 dForeign nationals who once held Chinese nationality may apply for* G6 G1 |0 I% `8 z
restoration of Chinese nationality if they have legitimate reasons; those- r7 E1 U2 E! c) u/ L
whose applications for restoration of Chinese nationality have been
9 @! |) Y D+ ?6 J) japproved shall not retain foreign nationality.1 n' S- o) @7 ?3 ^' g) E; {
Article 14
. M& R; K1 o6 H6 qPersons who wish to acquire, renounce or restore Chinese nationality, with1 A9 K- O! V6 [) j2 ~0 e0 ?
the exception of the cases provided for in Article 9, shall go through the
) d9 U: \6 m* ^+ @formalities of application. Applications of persons under the age of 18
0 I5 r+ q/ W7 N# C/ H! s" }0 G6 tmay be filed on their behalf by their parents or other legal
6 s4 a( z0 o" u$ J/ `5 w2 |6 Mrepresentatives.9 M: |0 H. b' U% ], K0 U
Article 15( W7 V, B. Y3 r
Nationality applications at home shall be handled by the public security
T# u M' u* N; Dbureaus of the municipalities or counties where the applicants reside;; u9 l% |6 ]+ N& K4 ~. T' u
nationality applications abroad shall be handled by China''s diplomatic
/ |( z, i& u4 j; d6 }/ D# X* yrepresentative agencies and consular offices.3 I! v8 ?! W) `: Q. k2 ]& ?* R
Article 16
0 r# i9 f# c# V% LApplications for naturalization as Chinese nationals and for renunciation
' C7 G2 w# p/ X& }! {4 c$ J+ z% zor restoration of Chinese nationality are subject to examination and
4 ]' A2 X& c7 ]* `; \* b& f( n/ t* k) \approval by the Ministry of Public Security of the People''s Republic of
. H* l1 u* O0 f9 k% jChina. The Ministry of Public Security shall issue a certificate to any* k) Z1 c8 C+ L% x0 s& H; ^& r. P
person whose application has been approved. q# F. f, ]3 t' M
Article 17
9 r* y8 v4 s" z6 tThe nationality status of persons who have acquired or lost Chinese7 O( G5 ~5 t! s& ~+ Y2 F
nationality before the promulgation of this Law shall remain valid.
4 x1 m' x- ?& U5 fArticle 18
; r/ m# }) j: z# g& OThis Law shall come into force on the day of its promulgation. |
