第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。! t a/ p% Q% x5 l- b+ o1 T7 _$ l4 ~
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。& V2 v9 z! Y/ Q' A3 Y$ T5 r
第三条 中华人民共和国不承认中国公民具有双重国籍。
8 J- z5 S% k/ J' M% t' W 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。. Q9 V& P+ d0 A1 Q8 p5 I
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。

第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

, W t3 h6 j) Z 二、定居在中国的;
5 G% m3 Q; T! |4 A9 G! ` h8 u5 [ 三、有其它正当理由。* g+ b* P! E. g: } G- `0 N0 X+ h7 ?
第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。$ {" k$ d* t- f7 U5 c, K- t) U
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
) ]( Z" [" q y* Q8 R1 n* \! M 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:! E6 u! `/ b% E% @8 b
一、外国人的近亲属;
. \5 i! Z1 a6 \" ?" Y; A 二、定居在外国的; v) B% B2 r+ y1 V0 L
三、有其它正当理由。
" |. X( g6 v: {; \/ Q$ O$ B- R: W 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
3 p/ \# J/ [, u. V0 M4 R 第十二条 国家工作人员和现役军人,不得退出中国国籍。$ n2 ?; L4 ?2 y- n& h
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
5 X2 l- G" h; [; Y% k8 f. R 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。0 y: u6 `- V' J5 G; P6 Y) C8 Y
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。3 t- [* G! T7 G3 e: [
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。- u+ M. K4 a; o
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

This Law is applicable to the acquisition, loss and restoration of# S5 T }( @9 O) R- s

of whose parents is a Chinese national shall have Chinese nationality.

Any person born abroad whose parents are both Chinese nationals or one of' n' ^9 l4 h0 q2 ^
whose parents is a Chinese national shall have Chinese nationality. But a

Any person born in China whose parents are stateless or of uncertain
" t- A$ E) k3 z4 ~nationality and have settled in China shall have Chinese nationality.

: v: g R# y% s$ |; a& Y# wForeign nationals or stateless persons who are willing to abide by China''s

naturalized upon approval of their applications:
, n z4 w. k0 u(1) they are near relatives of Chinese nationals;
& f9 s+ |* k: s3 v(2) they have settled in China; or- B+ u8 O7 P& M! ~$ U
(3) they have other legitimate reasons.

' g7 [, D5 _4 p! F& L$ oAny person who applies for naturalization as a Chinese national shall

whose application for naturalization as a Chinese national has been

Article 9
; D& h4 l6 Z4 h$ mAny Chinese national who has settled abroad and who has been naturalized8 d# Y7 L% _+ s) J
as a foreign national or has acquired foreign nationality of his own free
( V7 Z4 {: L6 A9 kwill shall automatically lose Chinese nationality.
! [, C8 d/ o3 i2 a& p5 K, b' Y; PArticle 10
/ T" `' O, }$ v( z6 z+ {, JChinese nationals who meet one of the following conditions may renounce7 n+ J! d# Y7 A, V0 A3 |
Chinese nationality upon approval of their applications:# m- w9 f# J) W, f
(1) they are near relatives of foreign nationals;
3 [4 V- E9 ~# l" |(2) they have settled abroad; or$ n, E/ x- y7 y. ]) g$ _ V
(3) they have other legitimate reasons.( t0 d* ]+ e# C% t
Article 11
& k" j$ o; }1 j* R. B+ Z8 n qAny person who applies for renunciation of Chinese nationality shall lose
+ H7 ~. K6 v4 s( m% E0 B6 `Chinese nationality upon approval of his application.. u, Z9 ]+ C" P. Y; l1 k- X
Article 12
. s+ S) x1 ?! M+ K5 [8 ?State functionaries and military personnel on active service shall not
* {) Q$ ], k! V1 c7 q/ t/ ~( drenounce Chinese nationality.
' h" j! Q; S% P) c" m1 S$ i5 ~Article 13 }8 N% b/ i! G
Foreign nationals who once held Chinese nationality may apply for
. B- d( H3 X" ?* M) j" Srestoration of Chinese nationality if they have legitimate reasons; those1 g& w/ ^7 [1 h8 {0 l& A3 X) _$ K
whose applications for restoration of Chinese nationality have been) u6 v# f, Y2 u& A# v- U
approved shall not retain foreign nationality.% ]" a# N1 v9 V, Y: ^* b$ _) S
Article 14
8 K0 k; q4 ~& i0 `Persons who wish to acquire, renounce or restore Chinese nationality, with
# A! `* T+ j7 c/ x$ m5 Dthe exception of the cases provided for in Article 9, shall go through the; ] y3 I9 v7 x- p& v a
formalities of application. Applications of persons under the age of 18
% ^; Q* G$ H" l$ j' H- Mmay be filed on their behalf by their parents or other legal% S+ i. [* p# Y. }; a/ Q% C# P
representatives.

& k) [, w: t* m: U X' c8 ?+ o' TNationality applications at home shall be handled by the public security; C' @1 g' n4 V, B) r
bureaus of the municipalities or counties where the applicants reside;) I! |7 ~2 g( @7 M! x4 V) C- z& |
nationality applications abroad shall be handled by China''s diplomatic
2 W5 [' `& ^0 i+ h c4 k6 Hrepresentative agencies and consular offices.
. c/ \0 i9 h8 h3 hArticle 16. N4 ^0 q) y) i" r+ S2 I' y& W
Applications for naturalization as Chinese nationals and for renunciation
! _. {0 o- }) i/ i) L& T7 Eor restoration of Chinese nationality are subject to examination and
. u6 f& ]6 L; ]: x4 I: q+ yapproval by the Ministry of Public Security of the People''s Republic of
1 u, Y- {) f" g+ B+ P& r' MChina. The Ministry of Public Security shall issue a certificate to any
) d/ G$ M0 G# qperson whose application has been approved.

6 p; \5 E; @! ZThe nationality status of persons who have acquired or lost Chinese7 O. w* W- a1 h
nationality before the promulgation of this Law shall remain valid.6 E8 k! ] ]0 A$ W/ h
Article 18
& N. }) ]; b! n5 C5 f3 ]This Law shall come into force on the day of its promulgation. |
