第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。7 Y8 L1 N. V R# v& T6 i
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
8 ]0 h$ Q, p9 d# c1 } 第三条 中华人民共和国不承认中国公民具有双重国籍。, i# H p5 L. Q+ `
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。! A/ g, q3 E- S" k% H; h5 f4 {6 q7 n
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
( p, Y F h! ]- K: B 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
0 f# ]( z; \5 p 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。3 p4 \: I4 n& X' K+ h6 w( b
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
; s* E! L0 C# K. H! q 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
& a: d3 S; h4 ? l 一、外国人的近亲属;1 B) H9 Y& N7 i
二、定居在外国的;
1 _' ?& z3 O, X; `$ P L6 J 三、有其它正当理由。
$ P! ?6 j$ ]2 T 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。0 U4 ~8 p' S6 x
第十二条 国家工作人员和现役军人,不得退出中国国籍。
7 Q3 d3 N- V3 F5 J% u1 S" I 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。+ `9 L0 Q. `# C8 \7 V1 F B
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。7 R( I q9 i( i6 t# I
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
0 D y. F) r D$ D; [ 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
2 i' g$ S4 y% m7 N" z# t% S 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Article 1

The People''s Republic of China is a unitary multinational state; persons

nationality.

Article 4
/ r9 y' S* L8 g+ L% ^1 o9 k) }Any person born in China whose parents are both Chinese nationals or one
8 d" B( Y2 ^ Q! j4 x' j$ yof whose parents is a Chinese national shall have Chinese nationality.

Any person born abroad whose parents are both Chinese nationals or one of
! V6 g2 @3 T6 C1 M# g& d! Z$ [whose parents is a Chinese national shall have Chinese nationality. But a. q2 O! u9 Y+ X
person whose parents are both Chinese nationals and have both settled+ n6 H+ K% b) ^" P- r6 k. A7 u+ K
abroad, or one of whose parents is a Chinese national and has settled( ]9 I) ^8 @/ S5 l# a
abroad, and who has acquired foreign nationality at birth shall not have

Any person born in China whose parents are stateless or of uncertain
. Y' h4 r* Z' M Y3 b% Y# F3 A Qnationality and have settled in China shall have Chinese nationality.

Foreign nationals or stateless persons who are willing to abide by China''s
: H4 r- Q6 v$ |7 c- D! d. |Constitution and laws and who meet one of the following conditions may be, C/ A+ X" H- {0 M& F
naturalized upon approval of their applications:
2 r0 m/ H6 ~) S2 c* f(1) they are near relatives of Chinese nationals;5 b; q' A1 u6 e; P4 l9 K" L# ?' B9 T
(2) they have settled in China; or
% ?# U" W* S$ V- i X(3) they have other legitimate reasons.

Any person who applies for naturalization as a Chinese national shall; |& ]% k8 H5 H
acquire Chinese nationality upon approval of his application; a person
. B& d2 ?& ?+ Q) \% ]* A8 a; p3 Cwhose application for naturalization as a Chinese national has been
; J! T8 A2 i2 {+ y8 Happroved shall not retain foreign nationality.$ q+ w3 a. p# V* G; k
Article 9( [6 V8 @# F& U6 q7 V4 M
Any Chinese national who has settled abroad and who has been naturalized3 Q0 _% F. m" c L1 y$ k$ o( l
as a foreign national or has acquired foreign nationality of his own free
: j$ S" h: f+ d+ p% w! g8 a8 Rwill shall automatically lose Chinese nationality.
7 c, x9 M8 k7 _/ sArticle 10
3 E; I& g- f6 N w L: |Chinese nationals who meet one of the following conditions may renounce) i- g q; a1 Q$ ?
Chinese nationality upon approval of their applications:; h: @8 O9 K, Y; s$ D' C: [
(1) they are near relatives of foreign nationals;
M: u) E% @* Y# O" ^$ D(2) they have settled abroad; or5 `7 T3 ~* Q8 J3 |7 h
(3) they have other legitimate reasons.2 \% E/ {5 Y) F
Article 11. Z) ^: o" }, n; s( d% o) ~
Any person who applies for renunciation of Chinese nationality shall lose) n9 C, s1 V; W1 N
Chinese nationality upon approval of his application.2 [7 S# Y! U) n% X. c3 Y
Article 12
/ ]* Y9 D2 N* W1 I3 [State functionaries and military personnel on active service shall not% W/ I5 E/ D! {* v
renounce Chinese nationality.& M" m, t% }. ]6 ?' U) x
Article 13
5 x" m9 ]0 V, B& F! PForeign nationals who once held Chinese nationality may apply for
& h2 r2 z2 W# g( ]+ y8 B, Orestoration of Chinese nationality if they have legitimate reasons; those# p6 c$ F" r' |) x3 V( J
whose applications for restoration of Chinese nationality have been, w& }/ b2 I/ b
approved shall not retain foreign nationality.2 Q2 y% p; z7 [6 p* K" |/ s; s
Article 14
$ W/ G4 }1 h& W% FPersons who wish to acquire, renounce or restore Chinese nationality, with8 v) U5 x& @8 g s+ T& t3 R8 t
the exception of the cases provided for in Article 9, shall go through the. D) q& L. R2 v9 N W+ {4 M, t
formalities of application. Applications of persons under the age of 18
1 @! N' u% p: L2 ?: L Y" l4 t- ymay be filed on their behalf by their parents or other legal2 }* z% y9 j: T
representatives.
% \1 I9 d! F/ w5 W, h7 ~" kArticle 15
4 i* b# _9 J- V4 CNationality applications at home shall be handled by the public security" j0 s2 B) {; Y9 c/ Y8 d' P. e' `
bureaus of the municipalities or counties where the applicants reside;
: z3 p5 T: B" i3 e. O, i! Xnationality applications abroad shall be handled by China''s diplomatic& q; K2 w9 a# _- v
representative agencies and consular offices.! S7 H& m/ M9 {+ z" w+ S
Article 16
" G. c: K5 Z5 r" b( c, u+ sApplications for naturalization as Chinese nationals and for renunciation3 x* g1 c+ p# f3 x b, @+ d
or restoration of Chinese nationality are subject to examination and6 E& Q, w* r. I4 u: P) O! D
approval by the Ministry of Public Security of the People''s Republic of
7 R. v* S; f G) _China. The Ministry of Public Security shall issue a certificate to any- [" \+ x7 V/ ~6 d$ _4 t* J
person whose application has been approved.

The nationality status of persons who have acquired or lost Chinese) n) C8 X% X! f! p5 K4 H
nationality before the promulgation of this Law shall remain valid.
