  . L' z2 G9 f; v, m, g- m
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
. P1 J* g$ C9 i4 V% m! J+ e    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。& Y; E7 U3 U& P
    第三条    中华人民共和国不承认中国公民具有双重国籍。: p/ M2 e  k/ R4 W; z' Q! m- M0 U
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。' M0 I3 `8 e% e) }
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
8 N0 t* o9 \8 J, w! b    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
: j- G& v- v6 S- P    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:1 j; f5 r/ j0 V  X% p% f, B
    一、中国人的近亲属;
8 ^) n! J  R1 I; S& M$ D    二、定居在中国的;1 a/ z6 I" X: y4 |1 I
    三、有其它正当理由。
8 ], v, f7 c5 K9 [+ \5 d    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
# g8 O1 z  U; L8 H7 T, a    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。) `7 ?( M( f4 X1 J8 u. W' z
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
* ?% e" B; x+ m) o    一、外国人的近亲属;. k+ ?! \" \" O8 M6 m6 Z9 o5 v. L
    二、定居在外国的;
0 {0 B/ G( U) N5 M* O    三、有其它正当理由。9 w2 w* |7 ?3 C0 E( ^
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。0 B. @9 |1 f( `* T* \
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
2 `8 R, L. E3 J    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
7 w! y+ C  m; l2 }    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
  x+ ?6 O5 A7 H! ~$ {    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
( q5 r/ \- a0 m0 o- G" I, l    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。  j: F1 J: f; T1 L  o
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Congress, promulgated by Order No. 8  of  the  Chairman  of  the  Standing

Article 12 Z% Z8 V1 X( ?
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of
' f* F; H3 w; r$ i- z5 B9 {! E! Xnationality of the People''s Republic of China.; v- l, ]4 U5 N* N  ]
Article 2
9 w5 l: _# ~  j) k, j) [The People''s Republic of China is a unitary multinational  state;  persons
4 O* `  {2 I) ?8 o) obelonging to  any  of  the  nationalities  in  China  shall  have  Chinese
5 F3 ?: k$ G0 W3 g2 T* o3 Inationality.+ J% I) }  F8 }0 T
Article 37 h0 A6 Z2 G: [- ]4 v' }
The People''s Republic of China does not recognize dual nationality for any
  \  d  E% E, e5 a+ r% m/ B* dChinese national.
5 X3 v( d$ L' G: A3 y3 ^Article 48 x2 Q4 T1 I9 U! i' Z- J/ F8 B
Any person born in China whose parents are both Chinese nationals  or  one
+ P/ _' O* O+ |: eof whose parents is a Chinese national shall have Chinese nationality.
8 v# J7 K: m: V  b* ]$ j- R' |Article 5
/ }- ?% C* L# s- S! t: Q. XAny person born abroad whose parents are both Chinese nationals or one  of
. q( d: k, b1 k- n1 zwhose parents is a Chinese national shall have Chinese nationality. But  a0 v, K2 D6 }* X) w  y# A2 X. ^
person whose parents are both Chinese  nationals  and  have  both  settled; v1 d/ [3 B1 M5 F
abroad, or one of whose parents is a  Chinese  national  and  has  settled$ B3 H5 f5 ~$ n2 T9 R' \
abroad, and who has acquired foreign nationality at birth shall  not  have
; e! ]( Y, a( S& O. yChinese nationality.2 N0 w; V& u# X* y2 c0 K& u; x8 s
Article 6
8 Q5 I- g* S% w4 h- iAny person born in China whose  parents  are  stateless  or  of  uncertain  |2 a0 A. u' N5 X1 q
nationality and have settled in China shall have Chinese nationality.
9 S# {7 Q4 x+ R+ F9 aArticle 7
# W8 F7 G* A- N, W) Q2 DForeign nationals or stateless persons who are willing to abide by China''s
- E* q( O) \+ g* S  D$ HConstitution and laws and who meet one of the following conditions may  be
- P* r+ N; O2 Z- s2 Onaturalized upon approval of their applications:% ]/ I7 w9 E. w: q+ H
(1) they are near relatives of Chinese nationals;  D. i! m; F- C5 C- f7 ?
(2) they have settled in China; or2 A% O  y  w7 |' A3 @( J
(3) they have other legitimate reasons." f0 X* M0 @% X! k  J
Article 8# D( ^' U, P( ]0 Q8 m/ U7 z
Any person who applies for naturalization  as  a  Chinese  national  shall" h% d1 |/ G  n) [7 G
acquire Chinese nationality upon approval of  his  application;  a  person$ W' n7 o- _" b; ]$ ]7 [5 y4 Y3 @
whose application for  naturalization  as  a  Chinese  national  has  been* p6 B" A% Q" t7 e
approved shall not retain foreign nationality.
! h$ f& ^, b6 nArticle 9
* \* P3 U, X( E% W+ g5 h. sAny Chinese national who has settled abroad and who has  been  naturalized& F+ k+ [' E# s8 j: T& a/ j
as a foreign national or has acquired foreign nationality of his own  free: t: j4 G9 U1 }" h& P, g& w
will shall automatically lose Chinese nationality.
8 G' u" t4 P5 I; H/ P" j: zArticle 10
( m2 O" q' p, G& J( wChinese nationals who meet one of the following  conditions  may  renounce
; a! v8 l- c( O$ _& m4 ~Chinese nationality upon approval of their applications:9 r6 Z/ h, C2 g: i! v/ r
(1) they are near relatives of foreign nationals;5 ]0 K! g6 C6 Y0 D) x: m
(2) they have settled abroad; or
  s; c$ k; O1 G. m' E(3) they have other legitimate reasons.- [. k. }7 N* n8 U
Article 11" G6 w5 a0 [* J* t+ q4 u" g; K
Any person who applies for renunciation of Chinese nationality shall  lose( F5 l+ {% H) o3 o% @2 m
Chinese nationality upon approval of his application.1 n: R. X) p; r- P* T
Article 12$ I' @: }( Z( V. K& [
State functionaries and military personnel on  active  service  shall  not
( m  M. c1 Z; \renounce Chinese nationality.
5 }. |7 t/ N, [+ NArticle 13- g! i* Q. y6 g, F) T0 Q5 L4 s
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for2 K2 a3 z' n! U5 f# Y
restoration of Chinese nationality if they have legitimate reasons;  those
" |: _/ I# I" Owhose applications  for  restoration  of  Chinese  nationality  have  been2 R- v* x' @; p/ d
approved shall not retain foreign nationality.) D  Z% w! C" k8 q" l0 {' `
Article 14
0 k" E0 {1 ^6 l% {Persons who wish to acquire, renounce or restore Chinese nationality, with/ P: @& ]* U! O8 r
the exception of the cases provided for in Article 9, shall go through the
9 n) z: H  v# o- g0 I& Rformalities of application.  Applications of persons under the age  of  182 p. u4 E' D0 f' [9 K
may  be  filed  on  their  behalf  by  their  parents   or   other   legal( ?8 X. ]: J0 H" z0 O0 f% w2 p
representatives.
4 J# u8 U" n( o; _Article 159 Q8 l8 U2 z0 d$ u) A
Nationality applications at home shall be handled by the  public  security8 B& a% c' n9 V6 S/ l8 P
bureaus of the municipalities or counties where the applicants reside;
3 @0 v7 H5 W. C0 m& s& Q+ ^nationality applications abroad shall be  handled  by  China''s  diplomatic5 w- S0 N( K9 o' _$ v
representative agencies and consular offices.
# a5 G3 \/ |, n: A( K; ?Article 165 Y0 @: y8 K6 t, h: R" B; `
Applications for naturalization as Chinese nationals and for  renunciation
/ Q3 }- x6 H: j- v* O# O1 {( Ior restoration of Chinese  nationality  are  subject  to  examination  and7 \& U0 E4 \  u, t, M# i
approval by the Ministry of Public Security of the  People''s  Republic  of- \, j, F6 D, B7 x! L* Y3 s
China. The Ministry of Public Security shall issue a  certificate  to  any
+ s; Y' b2 [/ k$ O; X( p/ c1 Eperson whose application has been approved.: v! U, U4 \% b# b% E4 r9 p
Article 17+ i5 s# p* ]& I* x8 p# f
The nationality status of  persons  who  have  acquired  or  lost  Chinese9 D! u5 V1 ^3 I, M. Z* _8 z& n
nationality before the promulgation of this Law shall remain valid.- Y  o# D9 o. z" B" ^. @% ~: p/ Y% Q
Article 183 L7 ?4 W) a& S: t) H- x& f; T
This Law shall come into force on the day of its promulgation.
