& R8 U3 S8 E  j6 \; m' W+ O 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。8 I) y- A( \/ T
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
) w6 l0 a& R+ p3 }! _% P: j    第三条    中华人民共和国不承认中国公民具有双重国籍。# \4 M8 G7 K3 t8 T" F
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
: Y, _0 o) x$ n+ M$ w& c' I    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。, }, q! w8 t" _
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
; Y8 h! `# C0 X+ t, l    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
' B/ g8 ]1 u) f: U0 i    一、中国人的近亲属;9 z' U; ]# Z& Q* e
    二、定居在中国的;
" P9 M& ~' t3 B. |% q0 K    三、有其它正当理由。
( e8 y. o& p  K: W    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。4 M. z: i, H* h- Y) o9 P
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。4 F# u" P3 Y& o' R! c; J4 |; N
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:; Z. [( l% E& x
    一、外国人的近亲属;
0 F. `3 I/ G( E' j2 {  n    二、定居在外国的;
9 P1 @) U7 U3 B) ]9 _9 z* v    三、有其它正当理由。4 \9 _, R2 }- ~% x" T6 R, ^8 u6 V
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。$ ^) U) s' r" C. k* E: v
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
2 U. x* L7 t3 y    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
# N/ O! V( [( k9 C+ z, A# D    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。  K9 W9 ?* R9 l$ i" S7 _
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。8 n8 W& V, R' k% f) g4 E; d
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。, M+ o7 [3 E7 x
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。) Z# P) t; F* T) n8 G+ A7 j
    第十八条   本法自公布之日起施行。- J  P! c! g7 M1 V% ^

Article 1
+ Q) N  h6 G6 C. sThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of& d" N& E) u- e+ _& x: U  u' M
nationality of the People''s Republic of China.' H. I/ P# R0 p/ O- H. X
Article 2" h* L& h& v! B: p3 ]: `9 k( X
The People''s Republic of China is a unitary multinational  state;  persons
7 k4 K" ^& |1 V( f, ]belonging to  any  of  the  nationalities  in  China  shall  have  Chinese! O  P# J9 U1 j+ G0 U
nationality.
9 m) q% A. H0 H: H' AArticle 3+ ~. l6 x" U+ ]& i7 P
The People''s Republic of China does not recognize dual nationality for any
5 i/ s# z; g3 Z) WChinese national.2 \7 p: d* Y4 S) g8 f
Article 4
4 h: U7 ~: q- a: \Any person born in China whose parents are both Chinese nationals  or  one
8 y0 S( r& ?1 Vof whose parents is a Chinese national shall have Chinese nationality.
3 f0 z# \4 L$ W4 {; PArticle 5
% L1 w) r5 x, z) eAny person born abroad whose parents are both Chinese nationals or one  of
; u' U( ~) }0 Jwhose parents is a Chinese national shall have Chinese nationality. But  a
7 j& M. {. c8 M9 Q; @7 ?* X2 m$ \person whose parents are both Chinese  nationals  and  have  both  settled
" P. i& ~7 k9 [2 r1 b3 s# Babroad, or one of whose parents is a  Chinese  national  and  has  settled
& B1 a. ~) e5 jabroad, and who has acquired foreign nationality at birth shall  not  have
+ q( _- k- T3 D+ VChinese nationality.4 p1 t- t( E) K$ v; X$ ^! S
Article 68 d1 A+ c7 {) e& t7 ^9 A
Any person born in China whose  parents  are  stateless  or  of  uncertain' C& f3 v8 H8 Z4 q9 A9 O5 t8 N  _
nationality and have settled in China shall have Chinese nationality.
( ?3 c% ~  \8 z* H7 j% BArticle 7
& l1 U7 J1 E  x' ~Foreign nationals or stateless persons who are willing to abide by China''s& X3 t* g6 n) T+ H" b! z5 ^
Constitution and laws and who meet one of the following conditions may  be9 I0 X5 P( h$ `- U8 k! q+ `9 \# H
naturalized upon approval of their applications:. }: X* I$ W$ p7 z) q; ]
(1) they are near relatives of Chinese nationals;
- I  n+ B) a1 N% x4 _9 C! R2 t(2) they have settled in China; or
6 w6 Z# O$ m2 M  T! Z4 j2 C$ T! j$ \(3) they have other legitimate reasons.
, l, C, `( O2 F6 FArticle 8
2 P- [7 V2 h3 R2 L/ u0 b( f1 i8 H! }Any person who applies for naturalization  as  a  Chinese  national  shall
9 T2 U: s7 ?8 u/ y! ]  ]acquire Chinese nationality upon approval of  his  application;  a  person$ q( A$ B# K' ~5 g5 x2 [
whose application for  naturalization  as  a  Chinese  national  has  been
/ `' [$ l+ E0 o) @6 ?$ ~approved shall not retain foreign nationality.
1 V. ?2 U4 J" n: N8 B4 P9 f% cArticle 9! e3 J! _9 w/ T" Y( R
Any Chinese national who has settled abroad and who has  been  naturalized  K% ~( q/ ?+ R' r
as a foreign national or has acquired foreign nationality of his own  free
/ l$ \: [/ a7 `1 H/ ^9 c) v; @will shall automatically lose Chinese nationality.
- i; W6 J+ q! H9 n* PArticle 10
: `7 x5 p" Y3 d, s- B7 IChinese nationals who meet one of the following  conditions  may  renounce$ r0 B0 Q, A7 R% a
Chinese nationality upon approval of their applications:
0 n% s7 |8 j4 ^9 O' P(1) they are near relatives of foreign nationals;
- B! T9 P/ i. n0 ^/ w0 M(2) they have settled abroad; or
5 d* ?+ r# ^6 X3 h) n9 E& C! \(3) they have other legitimate reasons.
( K9 j) N+ [2 p7 [6 f% z2 e1 }Article 11% H7 T; W3 }: @
Any person who applies for renunciation of Chinese nationality shall  lose: `9 |7 [5 a' a. `3 }* Z' I
Chinese nationality upon approval of his application.: O% F5 \7 C) m% Z+ [$ _
Article 128 e- t+ j- r: v" D( j
State functionaries and military personnel on  active  service  shall  not
/ c) D8 ^8 r4 F5 _2 U4 h! Irenounce Chinese nationality.9 m3 j3 i9 a* x
Article 13
3 m+ z" z( J( c$ zForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
$ `; M7 @, N( h7 [& {" orestoration of Chinese nationality if they have legitimate reasons;  those% l* Z5 n6 W6 b* u5 O8 \9 `
whose applications  for  restoration  of  Chinese  nationality  have  been
2 |& q! Y% `: ?# N  H1 A& {' m& |approved shall not retain foreign nationality.& Z9 a# E* t& {, Q+ L) I
Article 14
1 p) ?! a. h( ]  z9 ]  O$ WPersons who wish to acquire, renounce or restore Chinese nationality, with
- _' ^& Q0 `! }& G1 u% f' ^6 i  ~7 wthe exception of the cases provided for in Article 9, shall go through the9 ^# M! }4 S" P" @! |/ X' U$ W
formalities of application.  Applications of persons under the age  of  183 @1 p$ e) W0 h6 h' \$ N6 e
may  be  filed  on  their  behalf  by  their  parents   or   other   legal; F, y. R! M- b5 B! M
representatives.' i% T# l1 L" m  w+ ^- B
Article 15
  R- a' U9 s9 U, G1 Q% zNationality applications at home shall be handled by the  public  security' q" g* ?' t  l
bureaus of the municipalities or counties where the applicants reside;+ p! @9 x. a# D, Q/ {5 O
nationality applications abroad shall be  handled  by  China''s  diplomatic
& j6 r7 U/ W  g8 y+ P  Erepresentative agencies and consular offices.
: u7 i! w3 W( L$ G% F7 v/ I- }Article 16
( g, \. |, _5 n1 G$ [1 bApplications for naturalization as Chinese nationals and for  renunciation
) l. `: h+ @/ H/ l$ d3 }8 Bor restoration of Chinese  nationality  are  subject  to  examination  and# w( Z3 T: c# E  {# h
approval by the Ministry of Public Security of the  People''s  Republic  of
: d: g' ^( M4 X1 ?  YChina. The Ministry of Public Security shall issue a  certificate  to  any) ^5 V% s/ }5 y& F' f1 K
person whose application has been approved.
1 W3 T0 Q2 p7 a( @Article 17
4 k2 g0 V8 j7 ^The nationality status of  persons  who  have  acquired  or  lost  Chinese
. F" z( Z9 W3 g+ l* E' s' xnationality before the promulgation of this Law shall remain valid.
6 }; A' W# j2 ~* S0 eArticle 18
& v  g* Z* _" D; w) n0 SThis Law shall come into force on the day of its promulgation.
