《中华人民共和国国籍法》
) a) L# V( J( O  ( ?8 U8 p0 b+ w; E8 @( J& {
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
) o1 s$ \- J; `+ u  i    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。; H7 J5 S  }  c7 q& e
    第三条    中华人民共和国不承认中国公民具有双重国籍。
. j6 }2 Z6 S" L* Y2 K! w+ c    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。$ O4 j4 ?* _! x0 C
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。

    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
. N3 ?, G, e) q7 V, R& i    一、中国人的近亲属;
6 F; f" X' ?2 t' a    二、定居在中国的;
1 H$ Z9 k, F" |. d% V$ e) \2 N    三、有其它正当理由。7 F4 Y3 q+ X! E4 K& G. {% }
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。% ~6 k& f4 q- Q9 `& d0 _  u7 e5 `
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
3 Y. Z& g- `& j/ ^5 E    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:3 y, `. H! O. U
    一、外国人的近亲属;
' E- B  k9 |  H* d    二、定居在外国的;7 z7 ~8 M0 E7 R+ Y) Z0 L2 H
    三、有其它正当理由。. J+ R- u* v0 l+ N" V. p
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。% W3 T" I; [) p( M; l, p6 |+ Z9 C/ R
    第十二条   国家工作人员和现役军人,不得退出中国国籍。( g5 T3 u& F2 d- q8 \
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。9 [2 B& s8 B( z. Q5 `
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。! O. M) n& H+ K6 G( D
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。! B7 u# G( n( V/ R' w
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。. V# y- p. G- M2 T/ N$ s$ |
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Congress, promulgated by Order No. 8  of  the  Chairman  of  the  Standing
% q+ V5 z, F3 F; hCommittee of the  National  People''s  Congress  on  and  effective  as  of

Article 19 _3 S% A7 J2 V( |2 E1 F8 K# ?0 h
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of+ D& v' a; Z* ]* M
nationality of the People''s Republic of China.6 Q# H1 s2 }* G: t9 F
Article 27 n3 l* }. A, G. g; f
The People''s Republic of China is a unitary multinational  state;  persons
' c% r- t; F: j$ g# w- o3 j' @belonging to  any  of  the  nationalities  in  China  shall  have  Chinese3 D$ B3 B1 [! f0 x. t" V( K0 Z
nationality.& |0 a  m# }. |9 H/ r8 L: z
Article 3
- [  W4 j6 N; M9 P2 c. KThe People''s Republic of China does not recognize dual nationality for any' {; O) Z/ }( R9 i" D' h4 H8 ]
Chinese national.' @7 y/ C. q  V6 x# q9 K
Article 4
# f% W3 _  l7 \. _9 bAny person born in China whose parents are both Chinese nationals  or  one
( b  C& ~5 T' J9 B# p, o* Eof whose parents is a Chinese national shall have Chinese nationality.
" g  m2 V: {4 TArticle 5( C, A, k6 O3 H  \$ h8 k2 _3 i
Any person born abroad whose parents are both Chinese nationals or one  of$ M, p: M4 P5 a# c$ R
whose parents is a Chinese national shall have Chinese nationality. But  a
2 X8 R/ o/ \! _! U0 n% U, @3 Cperson whose parents are both Chinese  nationals  and  have  both  settled
9 c, \) _! O9 a4 G6 f- q0 yabroad, or one of whose parents is a  Chinese  national  and  has  settled
" Z4 B6 I1 \3 Z; S9 L) Qabroad, and who has acquired foreign nationality at birth shall  not  have
# m/ ?4 K' F5 CChinese nationality.+ W  ~2 q8 [" g" f7 t/ r  {! {3 v- ]
Article 6# V5 J! a2 h3 k5 ]: T$ t: g4 ]1 A
Any person born in China whose  parents  are  stateless  or  of  uncertain
) \  o9 A/ w6 d- Fnationality and have settled in China shall have Chinese nationality.
% |1 s0 S( h- n! K$ c. q8 D7 xArticle 7! C8 |; R( k& x8 [6 g# l3 N- i
Foreign nationals or stateless persons who are willing to abide by China''s
& s4 t; l4 i% R  E; I6 @9 EConstitution and laws and who meet one of the following conditions may  be
, I3 X" s6 o, y: K' }7 E5 H1 Nnaturalized upon approval of their applications:
" K8 V3 g: K) u6 A" \% @. b. N(1) they are near relatives of Chinese nationals;
) O% z9 ?* r! o" r" O(2) they have settled in China; or$ m7 y8 _/ z- h" i; i
(3) they have other legitimate reasons.
/ N% y7 m( q2 s) BArticle 8- S0 N8 P* R9 g7 S
Any person who applies for naturalization  as  a  Chinese  national  shall
' y; O/ w/ u5 y4 o. Lacquire Chinese nationality upon approval of  his  application;  a  person# ?8 c( @4 ^- \) ~
whose application for  naturalization  as  a  Chinese  national  has  been
3 M: L, l8 F8 h* }* j1 Oapproved shall not retain foreign nationality.
% j# h$ a. @- k2 qArticle 9
! r5 L9 U4 U6 c9 o% KAny Chinese national who has settled abroad and who has  been  naturalized$ W7 U1 y9 c1 x( R+ j2 v
as a foreign national or has acquired foreign nationality of his own  free$ ~% f( ~: C- Q- h4 \& K
will shall automatically lose Chinese nationality.
. F9 M5 P! m: _  c- {2 m$ `Article 10* e9 [' O8 m3 l; Y/ B4 F4 @/ t
Chinese nationals who meet one of the following  conditions  may  renounce1 {- s' t2 r- V7 P
Chinese nationality upon approval of their applications:' r# _% \4 B& b; d9 q7 c* i: H9 t/ @
(1) they are near relatives of foreign nationals;; ^& X1 Y- V9 C& Q& X  g, v& y
(2) they have settled abroad; or5 D6 G, J  ]$ T0 `3 g
(3) they have other legitimate reasons.

Any person who applies for renunciation of Chinese nationality shall  lose* ~7 i$ R" v: D% K
Chinese nationality upon approval of his application.2 R+ \6 ?6 D4 M* X6 _& E( S3 U9 S4 I
Article 12- r3 J& A; ^: q$ z2 t( i# s
State functionaries and military personnel on  active  service  shall  not# M; C& T2 o4 c) z9 F
renounce Chinese nationality.
; F& G! t  j; E) o+ U* tArticle 13
( E/ l6 D1 H$ OForeign  nationals  who  once  held  Chinese  nationality  may  apply  for! O, L5 y" M" E, t) @7 Q8 l
restoration of Chinese nationality if they have legitimate reasons;  those6 \3 x9 N9 N* w2 C, \2 X2 D
whose applications  for  restoration  of  Chinese  nationality  have  been
4 Y' W8 q3 V1 U7 G9 {) Sapproved shall not retain foreign nationality.# U; L4 E5 d7 l4 F
Article 14. V( B0 K7 G2 j! G1 S4 N
Persons who wish to acquire, renounce or restore Chinese nationality, with
1 E7 x: f5 x% V) G& Kthe exception of the cases provided for in Article 9, shall go through the
/ O% P! E# Z6 xformalities of application.  Applications of persons under the age  of  18
2 m/ v/ L: m$ X- |7 D! O9 Omay  be  filed  on  their  behalf  by  their  parents   or   other   legal
* v+ T5 g6 F3 B; F3 Jrepresentatives.
: I0 W% k! @2 X, _' ^8 \( j) V  p4 ]Article 15
# r% ]; D, ^7 Y! s  mNationality applications at home shall be handled by the  public  security
+ y: y4 Q8 m  {# _' Fbureaus of the municipalities or counties where the applicants reside;6 B. b, ~" ~6 ]) i6 j! i1 D. d$ Q
nationality applications abroad shall be  handled  by  China''s  diplomatic
* l3 ?, M3 h4 X: v! ?6 j" a  C' nrepresentative agencies and consular offices.8 L5 b( Y. @  P; O" g' U* G
Article 16
# |# ~( ^/ ]; q) I! z; P/ e, WApplications for naturalization as Chinese nationals and for  renunciation, {6 V  s, m) ^
or restoration of Chinese  nationality  are  subject  to  examination  and7 W* G3 U; n6 ^; |+ Y& g) }
approval by the Ministry of Public Security of the  People''s  Republic  of. x- x- J' n/ N1 @; g% s: j. d2 J6 r
China. The Ministry of Public Security shall issue a  certificate  to  any# F, g# _8 [. S' H. t
person whose application has been approved.
' K! j: _/ x3 c8 |6 s0 ^2 {Article 17
$ y  p& r3 L% A( C4 nThe nationality status of  persons  who  have  acquired  or  lost  Chinese' `$ P  P) k7 @  |9 y0 G# e
nationality before the promulgation of this Law shall remain valid.5 [8 i, h2 H# X3 I
Article 18% m0 h7 `( T4 B5 o
This Law shall come into force on the day of its promulgation.
