《中华人民共和国国籍法》 , i% ^( o% M1 I5 \" K, Z

第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。# |% Z) L! ]: F* ^( c9 R
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。" j/ R0 X# _0 F
第三条 中华人民共和国不承认中国公民具有双重国籍。) d7 A8 ]7 w' n; J
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
$ c, G3 h* H* j; C: i# i 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
/ D* d4 C* ?, T 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
# X4 B; s+ X! u9 ]$ E7 L% p 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

& M" h9 \( R5 W0 j& m! F, s 二、定居在中国的;, H3 O+ Y) O& u/ C; \/ I- ~7 X

第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。+ k5 O' g7 G( z' U! e6 Q! @
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
% z/ L$ \4 R B$ [9 O! l F 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
9 G! l0 e$ g$ G; H/ {3 U 一、外国人的近亲属;( [: D6 N9 S) t. s6 H
二、定居在外国的;. K, J$ {7 @; E6 z- E# K
三、有其它正当理由。
+ N5 L! C9 B' |* v 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
+ k5 ?7 k: x5 n' O1 H 第十二条 国家工作人员和现役军人,不得退出中国国籍。- n+ ^" C' [$ L& e
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
) D, F% l$ P. S* F1 J; f' T$ @( k/ L+ D 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
' |. A; P4 F9 }1 r 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。) N( c( t, `- j/ c X% w. U
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

第十八条 本法自公布之日起施行。

This Law is applicable to the acquisition, loss and restoration of

whose parents is a Chinese national shall have Chinese nationality. But a
! U# i4 z0 @% a6 Z/ P' C' _person whose parents are both Chinese nationals and have both settled

Article 6

nationality and have settled in China shall have Chinese nationality.8 s! C/ y/ k, Y$ _
Article 7
4 g. O8 H4 F# u& f" A8 B( K5 qForeign nationals or stateless persons who are willing to abide by China''s
" ?) A5 c4 ~ @9 z$ j' g# a1 ~Constitution and laws and who meet one of the following conditions may be+ F- a: Z# ?. `3 D4 o
naturalized upon approval of their applications:! n% y9 q" E/ S
(1) they are near relatives of Chinese nationals;
: Z% H9 h" l+ r* E7 [) N% [# i(2) they have settled in China; or
8 c0 x2 a( |9 [6 D2 V3 a: W(3) they have other legitimate reasons.

Any person who applies for naturalization as a Chinese national shall
/ `, P1 K- F6 l* z' ]: Aacquire Chinese nationality upon approval of his application; a person
& l2 W! y( W! r3 A7 Qwhose application for naturalization as a Chinese national has been
. |& Z+ c( o4 l( S( ~6 z( P% japproved shall not retain foreign nationality.
$ d* [, ?/ }9 h* ]Article 9
" A; T2 r0 u( vAny Chinese national who has settled abroad and who has been naturalized
6 S" |+ _) U( o7 z7 uas a foreign national or has acquired foreign nationality of his own free8 M N; U( b( x& V9 f: I- C
will shall automatically lose Chinese nationality.
) L* M1 V2 {; n9 s( c$ @2 _- cArticle 10
& i6 U+ e$ Y- E3 d7 B5 y RChinese nationals who meet one of the following conditions may renounce( W3 b7 e! b! C: U$ x$ x
Chinese nationality upon approval of their applications:% U L g7 }6 Z$ P: J
(1) they are near relatives of foreign nationals;
( C$ ]' W; j4 q, S# p(2) they have settled abroad; or7 y% i2 v6 j [; G9 h1 |& j& Q/ z

Article 110 m5 @7 W, ~$ U- H9 }" [9 ]
Any person who applies for renunciation of Chinese nationality shall lose% K# @: y/ g; N/ G; m W& M
Chinese nationality upon approval of his application.+ b2 _! e" v+ B% R
Article 12
5 h8 v9 H; f2 n/ L' i; ?/ ?4 fState functionaries and military personnel on active service shall not1 @9 Q% Y6 z( \
renounce Chinese nationality.
& R" Q8 v0 i6 ?' \! uArticle 137 ]. z7 B+ Y- T8 n+ r% [
Foreign nationals who once held Chinese nationality may apply for; B q% z5 P% [) T" v$ f7 X4 s
restoration of Chinese nationality if they have legitimate reasons; those
, ]' ?6 @& x/ e8 t3 Dwhose applications for restoration of Chinese nationality have been; l/ [, J' r; ]' L# r0 R, n
approved shall not retain foreign nationality.

Persons who wish to acquire, renounce or restore Chinese nationality, with$ D& W$ A% |% T. r- b% W: ?
the exception of the cases provided for in Article 9, shall go through the
& w8 k& A1 k4 {! z' O8 Nformalities of application. Applications of persons under the age of 18/ b& k8 m0 V' ~ Q8 l2 k1 g
may be filed on their behalf by their parents or other legal
: J0 E; s2 |# s6 `9 Frepresentatives.
' Z' Z# E( W& G7 @Article 15' t( r1 S4 ^; @, p+ s2 J
Nationality applications at home shall be handled by the public security
6 C7 Q% |) W. I4 [bureaus of the municipalities or counties where the applicants reside;& ~& V+ U, l/ ^- I: ]- A
nationality applications abroad shall be handled by China''s diplomatic
: v& u- {' H8 I6 A0 Crepresentative agencies and consular offices.* _- e( m5 w- S+ T/ R6 _8 d
Article 166 }, h" r+ `5 U* ^
Applications for naturalization as Chinese nationals and for renunciation
2 a; { Y7 L. y: A, ~or restoration of Chinese nationality are subject to examination and6 K+ p3 Z7 |3 k
approval by the Ministry of Public Security of the People''s Republic of' r4 X: t {( r# L& k# A' @
China. The Ministry of Public Security shall issue a certificate to any
! |9 ^2 Y# f7 U( v d/ C8 Jperson whose application has been approved.
+ v4 }9 i. M: U& I6 z8 @6 |$ v% eArticle 17* q+ t# A0 n$ v L h2 G
The nationality status of persons who have acquired or lost Chinese1 l) D, z) f0 i0 l- W- `' L8 E H
nationality before the promulgation of this Law shall remain valid.2 ~, x6 f8 C# A* `2 S( F
Article 18
