第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
+ g) C* V U: f- k. k& ` 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
1 F2 I8 ?' u- U0 L* k6 B1 F8 r 第三条 中华人民共和国不承认中国公民具有双重国籍。
( z2 [* ]# s( X 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
, s7 R) c7 N2 b! c 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。 o$ S7 p f; u
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
/ @+ z' k/ E+ V; _# O 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
: _! B7 L3 N% T/ b2 ] 一、中国人的近亲属;9 \: ^: v4 W7 g, ^
二、定居在中国的;
9 x% A% H+ y2 s% f5 b7 ?( r 三、有其它正当理由。
& r, o1 f3 s+ U 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
" }) W4 k; j7 f7 w& U 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
! j3 q6 t+ K2 i3 L9 S H8 E/ _ 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
) u4 S3 b" D( q9 J9 J 一、外国人的近亲属;% x/ x1 y Z/ }- N
二、定居在外国的;
R7 }) `0 [2 P5 Y/ Z @5 |: M( g8 h 三、有其它正当理由。
+ ^1 U' x8 ^: }$ f3 \8 i 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
/ ]+ t6 _" [9 s' d. p7 g) L( F 第十二条 国家工作人员和现役军人,不得退出中国国籍。
, Q8 e: {/ h5 i 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。: d% \+ M/ x" V. }( f
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。' d1 i2 q9 o/ T4 H
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
0 Z, q/ h; m& p& N: K: T 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
( T5 w0 r% U' q7 J 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Any person born in China whose parents are stateless or of uncertain

Foreign nationals or stateless persons who are willing to abide by China''s
7 t, j& G0 F5 \. j. CConstitution and laws and who meet one of the following conditions may be
9 |# Q `! U: I! enaturalized upon approval of their applications:
. h# G( d3 P0 c& [, h2 x7 p! ~; D(1) they are near relatives of Chinese nationals;
! v7 x# T6 v* C: s, V(2) they have settled in China; or
4 t& f9 o+ c, n7 m(3) they have other legitimate reasons.

F. O0 y4 m# K2 X; iAny person who applies for naturalization as a Chinese national shall
9 ^& t- j) `" ]( @' Y5 gacquire Chinese nationality upon approval of his application; a person1 X1 ~7 K1 ?# V' i0 o; r! V$ u: s
whose application for naturalization as a Chinese national has been: L0 C* C! _' X7 {0 o* X3 ^

Article 9
2 u1 p0 M6 k: ?0 S" `" D2 KAny Chinese national who has settled abroad and who has been naturalized: ^/ E' F2 a6 \+ Q. [9 `
as a foreign national or has acquired foreign nationality of his own free+ Y- {. Z# N! \. t) ]' q' T" @
will shall automatically lose Chinese nationality., x' z& U& ?: \# D) K+ g/ G" b
Article 10* n K L \0 A! m0 ?/ e# E6 e
Chinese nationals who meet one of the following conditions may renounce
- J h4 t R B; s i7 s+ vChinese nationality upon approval of their applications:- \- ?3 Q) L0 x4 ?
(1) they are near relatives of foreign nationals;
u$ A2 O9 L4 y) K p(2) they have settled abroad; or
8 [. C" W5 |9 w1 l0 o4 }(3) they have other legitimate reasons.

Any person who applies for renunciation of Chinese nationality shall lose
+ E5 k4 u: Z) u$ \2 @: P; pChinese nationality upon approval of his application.

State functionaries and military personnel on active service shall not
4 k) X# ^( ~- a7 I! Brenounce Chinese nationality.- ?/ e0 U7 R- a4 c
Article 13
1 m2 d% R# a. d* J: }& RForeign nationals who once held Chinese nationality may apply for/ Z. c5 W' N. a+ ~9 p9 o
restoration of Chinese nationality if they have legitimate reasons; those
- U4 h: ^# K1 ~8 cwhose applications for restoration of Chinese nationality have been2 H5 z: ]) y5 V
approved shall not retain foreign nationality.

Persons who wish to acquire, renounce or restore Chinese nationality, with9 X4 r5 `$ N% f' J1 O7 `8 n
the exception of the cases provided for in Article 9, shall go through the
2 x0 h$ s) }- Sformalities of application. Applications of persons under the age of 18% I r" i- A3 K/ Q
may be filed on their behalf by their parents or other legal' f# W* O E2 r a
representatives.

6 E: @* d: V C0 NNationality applications at home shall be handled by the public security3 B. o4 K# u; z1 G
bureaus of the municipalities or counties where the applicants reside;
8 F+ z3 S- q- m4 j1 {* k( ~5 fnationality applications abroad shall be handled by China''s diplomatic
8 w3 c% R) O" S7 C) R$ Wrepresentative agencies and consular offices.0 C4 h5 k& H& |; ~' L
Article 16
( U0 O: w) X# f; p$ L8 ~* F, A4 pApplications for naturalization as Chinese nationals and for renunciation
. p, j7 {8 p" Lor restoration of Chinese nationality are subject to examination and
& S+ F( S% F/ i. T/ @6 y% dapproval by the Ministry of Public Security of the People''s Republic of
4 h- w% q1 k& T/ @. ^China. The Ministry of Public Security shall issue a certificate to any* Q1 L* { E* j/ p% Y/ k6 V! P. t
person whose application has been approved.

0 w% V$ p/ a! l; S6 R- eThe nationality status of persons who have acquired or lost Chinese0 L7 ]1 D- K! |5 r5 ]% w! }
nationality before the promulgation of this Law shall remain valid.: p. F8 b+ O5 ^; C
Article 18
& b% S' Y) n' Q6 b/ {. C; vThis Law shall come into force on the day of its promulgation. |
