《中华人民共和国国籍法》 6 p% Q, P2 f9 Y/ V9 b( @0 J
 
) o/ i% ~% w! }  k 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。+ V% s0 U0 n1 N! v: B
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。; \0 C: m& ~; Q8 p3 o+ K" }
    第三条    中华人民共和国不承认中国公民具有双重国籍。9 Q7 X0 e8 ?/ @- `0 q
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
( n5 Q* b; {1 q/ S9 M    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
: w6 ~/ `/ r' {3 K9 i    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。  T# G; X% j/ s& h: h- {7 {
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
! I/ Y8 s: R8 Y5 ?1 G0 B    一、中国人的近亲属;
9 V, L( E* s- x% q. x    二、定居在中国的;
" S* ^3 a) x* V5 @+ r1 n* w    三、有其它正当理由。
( G7 L- b' G" z- [    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。8 T5 h! @) _2 P& x
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
0 I7 f+ E4 Z$ B! x    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
) x5 |9 |2 C7 u/ X$ E" f    一、外国人的近亲属;
( ?) d. h* |% K" z# y    二、定居在外国的;5 ?, A: H9 l! }  Z( p) y5 A
    三、有其它正当理由。
* n: f+ v) A5 J8 C- I0 @1 m    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
2 C% R% a% J, s" q6 p    第十二条   国家工作人员和现役军人,不得退出中国国籍。& n) i, a9 v" Q1 ?2 p6 _
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。! M# Q! F. c- D4 d: J1 H" u
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
8 S3 W4 K; w5 l0 \& F+ O    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
5 |$ X+ z3 v7 }  _3 r    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
6 c3 L& m2 J' V8 n. L+ t5 j    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Article 1
& I; p5 {! z6 zThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of4 U: b/ [: P& p
nationality of the People''s Republic of China.. a5 ^% k3 v) v/ ~# \5 c
Article 2
6 q8 Y3 _% B' ~' gThe People''s Republic of China is a unitary multinational  state;  persons# Y6 Z  U' G$ A/ A# C
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
2 i. K: Y3 V' ~$ X: B# s7 Knationality.; W! I+ ^6 r" h( i
Article 39 |; n% Y$ n' Z# @: ~
The People''s Republic of China does not recognize dual nationality for any
+ v& V% J% b- aChinese national.

Any person born in China whose parents are both Chinese nationals  or  one5 ^: u. y) I- J7 S1 a' T
of whose parents is a Chinese national shall have Chinese nationality.! h) J& [7 u) R8 z
Article 5$ d3 ^. |3 J& U! J5 ^) P
Any person born abroad whose parents are both Chinese nationals or one  of
( ]& i4 V9 h% t  \; P8 {whose parents is a Chinese national shall have Chinese nationality. But  a
, y8 t2 a! b5 ~9 Nperson whose parents are both Chinese  nationals  and  have  both  settled
( R, |6 |8 \# e6 D* E9 O4 Y5 Aabroad, or one of whose parents is a  Chinese  national  and  has  settled
/ |3 \3 \  O/ e! j6 U9 I  zabroad, and who has acquired foreign nationality at birth shall  not  have
+ U' g9 S, {: l3 j& e/ PChinese nationality.; ?( n* K$ `. \( v
Article 6& V1 N. ~0 }# |# j, n3 z
Any person born in China whose  parents  are  stateless  or  of  uncertain# ~. t6 D8 R, z/ e
nationality and have settled in China shall have Chinese nationality.
( n* S" _+ x6 F# dArticle 7+ h& e: ~7 P) _' K7 S
Foreign nationals or stateless persons who are willing to abide by China''s: W( U2 A9 ~# _- G: V% H, ~* [
Constitution and laws and who meet one of the following conditions may  be2 }: X7 F+ d  N' @5 w/ d4 F; D' k
naturalized upon approval of their applications:3 z2 O* B+ R# w: U! ?
(1) they are near relatives of Chinese nationals;
! a1 O. A2 X6 E! V# k(2) they have settled in China; or
8 J  z6 Q: y, `+ N+ S5 I(3) they have other legitimate reasons.; _& d$ i# W( l' d0 Z& h0 u1 K( ]
Article 8
9 u* x' b) P( t  [/ l" WAny person who applies for naturalization  as  a  Chinese  national  shall
; h+ p7 e( y2 O$ w- p7 @9 Kacquire Chinese nationality upon approval of  his  application;  a  person1 F9 }+ f2 t" q
whose application for  naturalization  as  a  Chinese  national  has  been( \1 T( r* U$ p. |. i" _
approved shall not retain foreign nationality.
1 W; n( Z& v+ w* j/ R$ wArticle 9
, g% m! S' Y; V: sAny Chinese national who has settled abroad and who has  been  naturalized5 A  ]( a2 j( ]. V/ ]8 }6 n
as a foreign national or has acquired foreign nationality of his own  free
5 y; }. v- A" p% \- v( _4 gwill shall automatically lose Chinese nationality.- H* `) o" k8 p6 p+ w5 O
Article 10
8 d8 w7 R7 k" P% ^Chinese nationals who meet one of the following  conditions  may  renounce
: Z- O- H9 c: b& d2 L4 iChinese nationality upon approval of their applications:
3 p! @4 p; o$ Z9 f. T2 o(1) they are near relatives of foreign nationals;& @5 W& T/ s6 W9 o
(2) they have settled abroad; or0 O1 v& V6 t  V/ N5 |6 h2 F
(3) they have other legitimate reasons.
/ ?' K! z. S3 Z+ v; s( J, cArticle 114 V/ z3 e$ Q, _
Any person who applies for renunciation of Chinese nationality shall  lose9 J1 i. D1 L1 Z% }4 R! b
Chinese nationality upon approval of his application.
7 y3 W: L2 w5 h9 h. T% IArticle 127 D8 o$ o  j' X4 ~7 y' j
State functionaries and military personnel on  active  service  shall  not
  S2 d; y% e+ k: D8 Mrenounce Chinese nationality.+ \3 Z* X& b/ z% v- t" H8 e
Article 13
9 M& e+ S/ C' o6 b8 zForeign  nationals  who  once  held  Chinese  nationality  may  apply  for" v& l7 l( J  M2 n; [9 C" \( }7 V( J
restoration of Chinese nationality if they have legitimate reasons;  those2 p- {2 T/ F6 Q! J8 ?" K
whose applications  for  restoration  of  Chinese  nationality  have  been
- L; L" |/ }2 x& Napproved shall not retain foreign nationality.
  Z- U/ c( \" y$ `4 `! l1 ?! aArticle 14
8 h- q8 ^# H3 v; @Persons who wish to acquire, renounce or restore Chinese nationality, with
. p' x) s. N, p8 u/ s0 Hthe exception of the cases provided for in Article 9, shall go through the1 m) Z/ i4 D/ x. K  p2 s) i
formalities of application.  Applications of persons under the age  of  189 u4 v' u+ T. L5 z
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
  e- u0 P- n) Q. urepresentatives.! Z  p$ I- {! D% S+ O4 I
Article 15
& Q8 c( Y7 M; o, l0 s8 NNationality applications at home shall be handled by the  public  security! R* P. ^4 p: B
bureaus of the municipalities or counties where the applicants reside;
" N3 ^: t7 q5 _7 C, B7 n+ [; e: ^nationality applications abroad shall be  handled  by  China''s  diplomatic6 a% c5 d- P3 l" \( C2 X% B+ c
representative agencies and consular offices.& v) J# \& R- E4 z" m( l
Article 16
. F$ I# l; U; i( R! y1 OApplications for naturalization as Chinese nationals and for  renunciation
6 u$ K* g$ W: ^+ ^' c& Z$ Eor restoration of Chinese  nationality  are  subject  to  examination  and. q/ Q* ~/ T/ N! T
approval by the Ministry of Public Security of the  People''s  Republic  of8 t' X9 P; z# [! X# O5 D
China. The Ministry of Public Security shall issue a  certificate  to  any, W6 L9 K5 Y# z
person whose application has been approved.* m2 O& h% u0 d" D* F8 {# ?
Article 17; `+ o: ]& T4 o# g3 m/ ^
The nationality status of  persons  who  have  acquired  or  lost  Chinese
! J! c$ V0 \6 T6 Z' r7 pnationality before the promulgation of this Law shall remain valid.
- f  i' h" x* b1 O( `Article 18
/ Q0 R$ w* f1 Q' K4 @8 \This Law shall come into force on the day of its promulgation.
