1 I( n; m) ?& n  m, H+ x! _(一九八0年九月十日第五届全国人民代表大会第三次会议通过)
+ k1 L1 K0 G* _《中华人民共和国国籍法》 ; n- f7 d6 @$ U' Q3 o
 
0 g( Z0 V! e* u5 I! A 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
9 M/ M' J  t2 V& y% S    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。" o% Y7 f: s) M9 N9 ^" U0 N: z" q
    第三条    中华人民共和国不承认中国公民具有双重国籍。! P5 t9 i( ^9 ?" |$ c7 u
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
. d, W, J$ R8 I4 B    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。+ p/ j& K1 c3 ~( F/ l
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
( U' I" B2 _4 J- J    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
/ X) d$ q$ N  Q7 I/ E+ B! \6 c. p: c    一、中国人的近亲属;0 K, ?( x% a9 P
    二、定居在中国的;, B; A  e& j+ E9 u$ k6 {
    三、有其它正当理由。, M, ~6 ~% T" M* W5 Q) R
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
# D) U. `& T+ Q; o6 D    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
0 y3 h6 \/ i! f, `  E0 y    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
2 e& F2 {8 B. O( I: b) b" p    一、外国人的近亲属;
0 d' W/ A& T+ w( h# L) \    二、定居在外国的;8 }6 w5 h( ?- H* }! G$ C) s+ i' j
    三、有其它正当理由。* z) l* @8 }* A( b- p& J
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
- q5 R+ _; Z# f* j( o7 S& k    第十二条   国家工作人员和现役军人,不得退出中国国籍。
. u( i# @& G; _: M/ D8 o3 S    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
( \0 B* l. j0 _) i4 C( g7 a9 f    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
1 S  [0 s/ f4 \; Q4 F# X  h, ~" S: V    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
! w$ z! [7 s; U6 H2 C    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
; B2 f  G3 L; u$ l* j    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。( E" h* D, A6 o% \0 W& e) J5 w# F. k
    第十八条   本法自公布之日起施行。1 C( i' v' ]- U

Article 1
+ b  N) _6 N% [' Y, u+ QThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of
& u  F% y& A3 o6 R6 `nationality of the People''s Republic of China.0 c, k0 E+ h% X/ V
Article 27 Q  N  H, B0 v# y- c, f1 X
The People''s Republic of China is a unitary multinational  state;  persons0 m: q* G# R% Y; m/ I% `
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese; J* y: a7 @* |, |
nationality.: d8 p7 \4 @* g- q- }
Article 3- T8 e+ G; n* i* y
The People''s Republic of China does not recognize dual nationality for any
1 \5 f6 W7 j) O) e4 _1 QChinese national.

5 X/ V3 J, s3 D3 R4 s/ [Any person born in China whose parents are both Chinese nationals  or  one* e8 u# I7 E& _; Y, A4 B+ }" q
of whose parents is a Chinese national shall have Chinese nationality.

Any person born abroad whose parents are both Chinese nationals or one  of4 O  ^" ?5 a) W% T5 H8 s6 o2 l
whose parents is a Chinese national shall have Chinese nationality. But  a
9 o+ \( P, }1 h% \& C# T' |# s+ \& Mperson whose parents are both Chinese  nationals  and  have  both  settled4 E: s0 ^5 h2 [: m, P
abroad, or one of whose parents is a  Chinese  national  and  has  settled
% n) l8 v" ]" _2 ^abroad, and who has acquired foreign nationality at birth shall  not  have
1 L7 Z) E7 n) L9 nChinese nationality.1 M; T4 t; p! q# m6 Y: j
Article 6
6 C: |) A0 R, |0 I$ `9 oAny person born in China whose  parents  are  stateless  or  of  uncertain
& T5 l7 O3 Z) u2 r1 ^% i% hnationality and have settled in China shall have Chinese nationality.. @. O/ Z, D1 r3 _" B
Article 7# b& q1 [3 a! s+ h1 g2 U3 B- [
Foreign nationals or stateless persons who are willing to abide by China''s) f  x3 h2 g. r( l
Constitution and laws and who meet one of the following conditions may  be. t" S1 a4 o. k" ?
naturalized upon approval of their applications:
9 u8 {- F$ o/ r! {. W1 d; l(1) they are near relatives of Chinese nationals;1 v8 p; D8 j1 |4 R9 O9 c# q
(2) they have settled in China; or
4 a% b+ l% J, J5 }* p(3) they have other legitimate reasons.; [* e" h6 N9 K, c  V5 \1 p7 }& p; z( U
Article 8, o9 g, d, S# @, b( y
Any person who applies for naturalization  as  a  Chinese  national  shall. X! t8 p. S* b
acquire Chinese nationality upon approval of  his  application;  a  person
$ K$ @: e% A) R$ C5 r$ a: |whose application for  naturalization  as  a  Chinese  national  has  been
; t- {  B* L7 n# a0 Sapproved shall not retain foreign nationality.
  N: b1 C9 \, U' @Article 9
* x3 `4 q5 B; Y$ ~1 iAny Chinese national who has settled abroad and who has  been  naturalized
% b# I. }: _, A6 A1 u- ~as a foreign national or has acquired foreign nationality of his own  free
/ h) `& z# V0 {  Pwill shall automatically lose Chinese nationality.. p. F6 J, a% Z9 s
Article 10* n& L# |( ^% o* p
Chinese nationals who meet one of the following  conditions  may  renounce" L( `: w- E1 M" G  ^
Chinese nationality upon approval of their applications:
. c4 G2 q9 u  v* Z(1) they are near relatives of foreign nationals;8 o1 \$ S0 P% v. m
(2) they have settled abroad; or
) M3 M' T+ c, h" d7 k, ^(3) they have other legitimate reasons.

& V8 C8 A: z. yAny person who applies for renunciation of Chinese nationality shall  lose+ G( u$ t2 l2 ~3 c0 p5 R# E
Chinese nationality upon approval of his application.) F! L+ B* T' T% I0 s% l4 }2 t
Article 12
/ S3 t* p# s; E& \* S, r3 tState functionaries and military personnel on  active  service  shall  not
  V$ v" ^/ B- h4 srenounce Chinese nationality.
5 e' w' c  x, ZArticle 130 ^# ]- e( c9 x; l6 y4 R$ p
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for
% B1 g1 c  s7 i  E7 H$ E+ Wrestoration of Chinese nationality if they have legitimate reasons;  those
0 m6 k( K) j/ ]' p3 awhose applications  for  restoration  of  Chinese  nationality  have  been
) P" w* J8 ^) l/ v9 tapproved shall not retain foreign nationality.
) L* T6 E3 f& z1 Z' c, lArticle 14
+ Z) o" m# Q& y. E* K5 cPersons who wish to acquire, renounce or restore Chinese nationality, with
$ U4 J: }* p" \3 ~the exception of the cases provided for in Article 9, shall go through the  q+ M0 g! ~3 b! a& L5 W9 `# J
formalities of application.  Applications of persons under the age  of  18
1 |* J7 s. E/ d$ Bmay  be  filed  on  their  behalf  by  their  parents   or   other   legal6 ^7 D8 S" j8 o4 Y. Y, v
representatives.
4 S' s2 u& O9 @; b) P* q- r6 l& qArticle 15
$ t* p: k" h; L2 n5 jNationality applications at home shall be handled by the  public  security* G, U& p: ]: B" _: h& I- K* u
bureaus of the municipalities or counties where the applicants reside;
( Z) R5 G$ ]- }9 @( Znationality applications abroad shall be  handled  by  China''s  diplomatic: v: F: W5 c  M8 D9 O
representative agencies and consular offices.# e5 F5 P( {; H) P  S9 R
Article 16
. q& P1 N: e' w! g7 A% F. WApplications for naturalization as Chinese nationals and for  renunciation
' R/ G: U9 e: u. O1 I9 K) u+ Zor restoration of Chinese  nationality  are  subject  to  examination  and" ^, C7 _7 w5 d/ _" m" q
approval by the Ministry of Public Security of the  People''s  Republic  of* B9 I: j: @$ U
China. The Ministry of Public Security shall issue a  certificate  to  any
6 B9 D4 h5 U# Uperson whose application has been approved.3 B$ M; m. C5 h/ E* T
Article 177 r$ C" K: O! ^( d( C
The nationality status of  persons  who  have  acquired  or  lost  Chinese
) s* w; T3 N" Cnationality before the promulgation of this Law shall remain valid.' T* a2 w- A1 D( n5 }
Article 18
& Z6 H2 j0 r1 z# NThis Law shall come into force on the day of its promulgation.
