第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。( Q+ a2 X. ]2 \6 L+ h5 }) `
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。9 `1 F6 W( L8 x0 c; _* u
第三条 中华人民共和国不承认中国公民具有双重国籍。
: v4 {3 E; }' k- `. s+ \2 l 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。+ g' b' e' p, T' Z, i: K9 y
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
, ?$ `8 [% e8 S9 P6 X 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
+ w1 f( j% x# A$ c4 I* g. {" j 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

二、定居在中国的;3 l# F3 C! u. i4 |5 K
三、有其它正当理由。
. s7 y9 Y8 d$ A8 i1 a. N 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。. Q8 t9 P4 q. Q9 M; ?
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
! C' i, t" D4 |5 ~3 [& D 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:5 q$ W8 c- e9 M6 p* e, a% ]
一、外国人的近亲属;( Z( B: c* D- y! C" M f; p
二、定居在外国的;5 O" D1 V! Y% @9 J
三、有其它正当理由。
/ ]+ v" S; a$ s& B 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。: Y' T6 B+ O" I9 X( ~ N& N5 f$ N9 }
第十二条 国家工作人员和现役军人,不得退出中国国籍。
4 w# m# f. t4 w" K0 F7 M 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
, Y7 x) d2 X' x6 }. j 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
- g9 O- a U% W 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。9 O$ a) p; \" V) r- e( O6 C3 b
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

This Law is applicable to the acquisition, loss and restoration of
8 S1 N2 L- [5 R6 C& ]nationality of the People''s Republic of China.

, n0 N5 ~2 B/ I1 E# ZThe People''s Republic of China is a unitary multinational state; persons
0 A) q R! p+ Q8 T7 e4 D) ~belonging to any of the nationalities in China shall have Chinese( d4 _. v5 s* j# o2 p
nationality.

Any person born in China whose parents are both Chinese nationals or one
% o( H5 n7 W/ l7 C2 x$ \4 t" |- Pof whose parents is a Chinese national shall have Chinese nationality.+ h8 ^$ C: j# c

Any person born abroad whose parents are both Chinese nationals or one of( I, c2 \5 ]$ s% A% @ X
whose parents is a Chinese national shall have Chinese nationality. But a
( _: |' }4 X) Q( m- E; L/ \3 qperson whose parents are both Chinese nationals and have both settled
& |+ F$ v% v k$ u5 habroad, or one of whose parents is a Chinese national and has settled5 \ k2 p1 K7 R! s$ t6 O
abroad, and who has acquired foreign nationality at birth shall not have

Any person born in China whose parents are stateless or of uncertain
( H9 O( G+ w" L* C5 |/ f# I$ O) unationality and have settled in China shall have Chinese nationality.: l- m( m7 d4 j( N

8 W8 M0 f3 R$ X" ^( ^Foreign nationals or stateless persons who are willing to abide by China''s7 i' W- O3 H2 U9 T& _% E3 b
Constitution and laws and who meet one of the following conditions may be1 \1 ?7 s/ ]* w: g4 }$ M+ b" p7 Z; |
naturalized upon approval of their applications:; A; H- y. s1 ?) Q
(1) they are near relatives of Chinese nationals;

(3) they have other legitimate reasons.

# E7 f0 |- P0 r( {+ B' `' GAny person who applies for naturalization as a Chinese national shall
9 z+ [ y& j) L; Racquire Chinese nationality upon approval of his application; a person
1 K2 z4 C$ k' E( X2 L# X1 N3 swhose application for naturalization as a Chinese national has been
5 n* q% \3 {* Bapproved shall not retain foreign nationality.

3 F( J+ n9 h+ x: wAny Chinese national who has settled abroad and who has been naturalized! O6 k3 _! y8 p; b' C
as a foreign national or has acquired foreign nationality of his own free' B1 P% J& \# n
will shall automatically lose Chinese nationality.
# d3 X; ]' U/ R P" k8 w, NArticle 10! F6 N2 O3 o9 h/ e
Chinese nationals who meet one of the following conditions may renounce, ~; N( H$ H- {; m* ~' \
Chinese nationality upon approval of their applications:/ Z6 v* t8 M5 R! \* Z
(1) they are near relatives of foreign nationals;+ E6 f$ W) `1 \
(2) they have settled abroad; or

Article 11
. r; d7 q8 u; q6 t& @# i7 IAny person who applies for renunciation of Chinese nationality shall lose
) L; T% c5 I! C% c: qChinese nationality upon approval of his application.
$ E* [- x- s0 g0 l/ }5 CArticle 12 @2 N; K. z" Z0 a
State functionaries and military personnel on active service shall not
- D' j( b8 v" v# G+ J. E; wrenounce Chinese nationality.
% ?& g- K* l2 X# a2 c- tArticle 13
& I/ d W: h" b: ?/ [Foreign nationals who once held Chinese nationality may apply for% |7 \3 w9 F; ^+ W7 j$ n
restoration of Chinese nationality if they have legitimate reasons; those0 z" L Y9 C+ c# f2 K( `
whose applications for restoration of Chinese nationality have been
8 s; A5 y- u0 }& B( a. {% U% capproved shall not retain foreign nationality.

' d& E! x! m0 J5 P I% C) BPersons who wish to acquire, renounce or restore Chinese nationality, with [! V& V! d: V7 D
the exception of the cases provided for in Article 9, shall go through the
! V/ g" ]- u! W9 vformalities of application. Applications of persons under the age of 18' n4 T6 w {9 b. Q% g4 V; m
may be filed on their behalf by their parents or other legal8 t! R% v* r3 c0 e
representatives.

Nationality applications at home shall be handled by the public security
. P; j* x& b2 Z7 v4 B, m2 O& nbureaus of the municipalities or counties where the applicants reside;! |, X- Q K! @! L# |3 ^
nationality applications abroad shall be handled by China''s diplomatic( \$ A( ^/ ?% r& z0 s
representative agencies and consular offices.1 s6 v4 t2 ~% \+ l' T% S7 ^7 w U
Article 16& d0 a' o5 P3 n
Applications for naturalization as Chinese nationals and for renunciation
. ?0 h# Y, L1 C3 h! s: F) @) oor restoration of Chinese nationality are subject to examination and- a' F& i% j x' v5 T' R6 e
approval by the Ministry of Public Security of the People''s Republic of
9 q; V/ X3 t* q% i6 X7 k" \0 b2 XChina. The Ministry of Public Security shall issue a certificate to any( v4 H6 S3 [4 |9 }1 j
person whose application has been approved.7 J8 z/ c A- P. {5 ]
Article 17* W8 Z5 z# V/ i* d
The nationality status of persons who have acquired or lost Chinese
$ A# ~; [7 z+ Q8 k$ Y6 Vnationality before the promulgation of this Law shall remain valid.

This Law shall come into force on the day of its promulgation. |
