《中华人民共和国国籍法》

+ q3 P: [* p5 [& f* e 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。9 k6 X4 _! G! o6 m
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。3 i& r& w6 I; b
    第三条    中华人民共和国不承认中国公民具有双重国籍。' L6 ^. S% u1 |5 Q; y' Y) F+ s! s3 x
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
) z5 U( _2 T% G+ w7 i' H    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。, c4 A1 H, Z/ G' w5 k7 H
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。1 t! z  [6 g" e# B  q- {) K
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
- d% J( I6 _/ F1 r; [; W! h    一、中国人的近亲属;
' g5 p7 C' p4 {, N# n  v3 g; j4 I3 |6 y5 R0 _    二、定居在中国的;8 f- K0 Y; l8 p! M1 U) r
    三、有其它正当理由。
* o: s/ h+ V/ J7 s6 f    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
; J* O# L  y! H& E( x" h% q( i( X    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。9 |* Q- Q+ z: S$ T0 Z
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:+ F' h6 [# A3 _% Y, d5 X0 e
    一、外国人的近亲属;$ p0 [9 c  k% b- ]2 R7 G, t( [
    二、定居在外国的;
6 @# L5 g$ q5 C/ G, g8 @9 H' I    三、有其它正当理由。
* s0 y' f' E+ L8 U: w# h8 @0 y    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
2 F* {3 r" D- F7 D- k# L    第十二条   国家工作人员和现役军人,不得退出中国国籍。
: r+ u9 e# N1 r9 J" i    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
1 r. S* Q1 L( v8 v& ~2 y  H# X    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
- N1 m: q0 j. E+ @3 c' A! o4 Q    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
- s8 G7 w# X- T" C+ }5 n9 N+ t    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
9 F$ I* n& F5 K0 g    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。
# }5 A) b$ Q1 e    第十八条   本法自公布之日起施行。

+ v4 x7 [) Q# X* s" OThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of
! W% {9 y  ~  q8 Q/ t- ~* Onationality of the People''s Republic of China.# q1 j, {7 i# v! S% T) H
Article 2; G* ?2 V( ^5 K% f" [# b( S
The People''s Republic of China is a unitary multinational  state;  persons
7 y# p. j" q8 z+ mbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese
+ z3 y8 X$ p  _$ o5 J8 fnationality.
" L6 i2 B/ y: R8 J* hArticle 3) |% f6 p2 b: h+ d7 L9 N. H9 j# Z
The People''s Republic of China does not recognize dual nationality for any& {5 P& {3 x# i6 n( L
Chinese national.# N: K1 q  `$ k9 x. Z
Article 4
6 e0 L2 P  E+ }8 I% y$ yAny person born in China whose parents are both Chinese nationals  or  one
0 f6 l4 E4 M3 cof whose parents is a Chinese national shall have Chinese nationality.
0 S9 C2 O' c) F$ _- @: O* ~Article 5
% ^; t, {  o# ]4 @* h/ xAny person born abroad whose parents are both Chinese nationals or one  of$ t) p% d) C/ l8 Y7 q
whose parents is a Chinese national shall have Chinese nationality. But  a% T* G' |  Y6 |! ^
person whose parents are both Chinese  nationals  and  have  both  settled+ V$ G, A5 v( a: {) c. F& H2 Y
abroad, or one of whose parents is a  Chinese  national  and  has  settled
+ f) P. Z+ O6 ?9 J, c# V0 B0 U* dabroad, and who has acquired foreign nationality at birth shall  not  have
, k  T! [. [3 l! h& DChinese nationality.. D. U: X3 y% x3 |) e# j8 c/ d
Article 6: @+ k: r. S* _
Any person born in China whose  parents  are  stateless  or  of  uncertain
* E- p. M4 d: b- m+ I: Q. Vnationality and have settled in China shall have Chinese nationality.
! o; T) B0 [, _1 G9 WArticle 7
( y( b# e! _2 I6 |! W; P7 cForeign nationals or stateless persons who are willing to abide by China''s
' u& w5 @# i$ s, d3 Y7 XConstitution and laws and who meet one of the following conditions may  be4 \; ^( \: R/ F  D- ^* A
naturalized upon approval of their applications:
+ G% j6 c$ e2 |(1) they are near relatives of Chinese nationals;: X2 P2 `3 y7 ]1 c( B
(2) they have settled in China; or
  m4 v% X4 \  {+ e8 n# Q7 \(3) they have other legitimate reasons.; y' C: f5 b# a& X! @
Article 8
3 M( J# q8 {0 ~6 ?1 M: vAny person who applies for naturalization  as  a  Chinese  national  shall
; O, k+ \5 Z6 k4 l1 B7 `+ wacquire Chinese nationality upon approval of  his  application;  a  person2 y" j* P/ @, \
whose application for  naturalization  as  a  Chinese  national  has  been
/ {9 U2 y7 e8 F4 l9 Mapproved shall not retain foreign nationality.4 [/ [2 B6 K0 b! c/ b/ _
Article 9
% i' X7 y: f0 @  bAny Chinese national who has settled abroad and who has  been  naturalized' a9 |0 B1 _; p/ K4 x( m3 i
as a foreign national or has acquired foreign nationality of his own  free
% m0 `+ L' i# Zwill shall automatically lose Chinese nationality.
( r9 a$ l% p$ w3 S4 DArticle 108 z3 o' p1 M& Q+ \
Chinese nationals who meet one of the following  conditions  may  renounce
; x8 O. O* Z/ t1 P5 uChinese nationality upon approval of their applications:
  h5 z8 d% t. Z1 k7 J(1) they are near relatives of foreign nationals;7 x& w; d5 w. I6 K( Y- ^8 E. _
(2) they have settled abroad; or6 G6 O% O( Z+ w( j" h' q" J
(3) they have other legitimate reasons.
% m" h+ C/ \' K3 j9 oArticle 11+ M- K- P+ v3 q; s- [' J! n
Any person who applies for renunciation of Chinese nationality shall  lose
5 D4 p0 E0 l1 |& k2 h6 ?+ W" mChinese nationality upon approval of his application.
" g, j. b/ h( D! a% f- ^" c( mArticle 124 q$ m0 ^  A/ N, N7 I
State functionaries and military personnel on  active  service  shall  not
( X) K, T+ X* _7 x( jrenounce Chinese nationality.
' ~: \/ G3 R( h. b" X0 u9 hArticle 13" E  o: T3 n1 i" n4 w+ T" b
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for
1 X" a$ H1 q4 X: b1 N" ?' N! qrestoration of Chinese nationality if they have legitimate reasons;  those1 K0 a. M" i5 S, p# d4 X7 ]
whose applications  for  restoration  of  Chinese  nationality  have  been
% d3 E: a! K. I; M) Yapproved shall not retain foreign nationality.
4 Q! `, l% i: PArticle 14
! t# b, v, ~7 MPersons who wish to acquire, renounce or restore Chinese nationality, with) U0 J2 _4 y- S
the exception of the cases provided for in Article 9, shall go through the2 P& C: g6 v+ \9 Y9 ^0 F
formalities of application.  Applications of persons under the age  of  18: V; s7 z$ f$ I$ T
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
) Y, S$ D# j! _2 q* prepresentatives.
% O; B* Z  w- b/ c' M, HArticle 15
& i$ i3 ]! @3 b" ~: Z4 y: TNationality applications at home shall be handled by the  public  security
, Y: U& g8 J( O# m" zbureaus of the municipalities or counties where the applicants reside;
5 x- f! T  x' w0 knationality applications abroad shall be  handled  by  China''s  diplomatic$ Q: v5 W7 @, y" n0 h# _7 |% n
representative agencies and consular offices.
) j& b" \" T6 @1 A" @5 ZArticle 16
0 s/ |- n# J6 t7 L2 j) SApplications for naturalization as Chinese nationals and for  renunciation
. K) G+ m9 q# V; U3 \4 y- \or restoration of Chinese  nationality  are  subject  to  examination  and
3 i3 i- a! {; f6 M4 W9 ]: T  Wapproval by the Ministry of Public Security of the  People''s  Republic  of' g: t: a  `9 @" `
China. The Ministry of Public Security shall issue a  certificate  to  any! d4 e1 X3 J! m/ O/ r
person whose application has been approved.8 b1 E' R1 y7 n8 e
Article 17$ d# S$ @* k' P8 I/ z" c* Q& m
The nationality status of  persons  who  have  acquired  or  lost  Chinese+ l) @$ i! X( ]1 |# U" Z2 C& U
nationality before the promulgation of this Law shall remain valid.0 y, C9 b+ L6 K$ u
Article 18
! Y- ~( U4 ?0 @- O$ S0 C# f! RThis Law shall come into force on the day of its promulgation.
